Is this a store front or internet? Except in rare check fraud cases by storefronts you can't be arrested for defaulting on a loan. We do not have debtors prisons in the US in the 21st century. It is most likely an illegal scare tactic. What state are you in and have you made any payments on this loan. If so how much and how much was the loan for?

You can not be arrested for non payment of a pdl. It is a scare tactic to get you to send them money. What state are you in. Is this your only loan?
How much borrowed, how much repaid?

I currently have 4 payday loans.
Ace Cash Express - $400 paid $81.42
The Cash Store - $800 not to sure how much I repaid lost some of the paperwork.
Check N Go - $550 but already paid $150, $212.11, & $50
Advance America - $783.80 paid $200.
All these loans are storefront and my state is Texas. I recently signed up with Town & Country in March.

I signed up in the beginning of March. I have already paid my retainer fee and began my weekly payments. I just got shook up when I received this call. Actually they called my brother & then he called me & told me that if I didn't go to their store here in town & make payment they would have a warrant for my arrest first thing tomorrow. So I freaked out & decided to post on here to get some advice and reassurance.

Please be careful because Texas is the one state where you can be prosecuted for defaulting on a payday loan if fraud can be proven. The fact that you have made payments on these loans, to me, shows there was no deliberate attempt to defraud. If you took the loans and tried to hide that would be different. To me this is just a scare tactic. Like Paul said, let T & C handle it.

I don't want to sound stupid but what do u mean by fraud?? I will definitly give T&C a call.
To prove fraud, they would have to find proof that you took out
To prove fraud, they would have to find proof that you took out the loans with the INTENT to defraud the company - in other words, you took out the loans with no intention of paying them back - ever.
The fact that you have attempted to make payment on all the loans would make that hard to prove. But I would definitely follow the advice given above by Paul - get in touch with T&C and make them aware that Ace is harrassing you.
I plan to give them a call. I thought everything was going good
I plan to give them a call. I thought everything was going good I haven't received a call from any payday lender until today. But I will call T&C and I will keep u guys updated...Thanks for the advice

dobrey,
Do not worry about Ace. They can sue you civilly and garnish your wages, but you cannot go to jail for it and if they have specifically told you you would, file a complaint.
If they do sue you, you have about 90 minimum before they will garnish your wages from the date they file.
