This is the second one who has tried this tactic...telling me the account was open. I have talked to both bank managers and the tellers and they have told them no such thing?
What now?

The bank has to tell them if funds are available to cover the check but can not cash a check made payable to a company and turn it in to an official check. At least not from my knowledge. As long as they have the check they can try to process the check.
Is the account open? If it is they might try to deposit the check. I would think the bank would be closer to telling you the truth than the Pay Day Lender.

Sheesh, they sure do have a lot of ruthless people working in the pdl industry, that was low, I would have been furious. :?

Angel...the account that the check is on was closed. But she is now telling HER manager that I lied and the account is open?
Pulling hair out here. I just want this nightmare over.

Don't pull your hair out and try to relax... They are obviously just trying to drive you crazy!
If the account is closed then it is closed and I'm not even sure why it would matter if you lied to them or not. If it makes you feel better as for a letter from the bank stating that the account is closed and the date it was closed and then mail a copy to the Storefront. The bank shouldn't have a problem with providing a quick letter for you.
Just curious... what is the point the Storefront is trying to make??

Egypy, as long as the account is closed, please try to calm down. These pdls are so low, they will try and say anything.

Angel, I am guessing they want me to think tht I am low and just do not want to pay them? I am also guessing that this gal was mad because she could not get a certified check on the behalf of her company...or they want me to admit I have another checking account?
The bank has assured me that they lead them to believe no such thing?
I'm sure they want you to feel bad about yourself but don't! Yo
I'm sure they want you to feel bad about yourself but don't! You can only "do what you can do" and that is all there is to it!
Even if you have another account and the funds are in it there is no way for them to cash a check drawn off of one account from another account. It would also be hard for the bank to make that type of statement to a non account holder (the Storefront)without breaking some type of privacy law. It's possible that IF the Storefront manager went in to the bank and asked them if there were funds available that MAYBE one of the tellers told them something like "not available in this account"....
Either way the point is moot because the account the check is drawn off of us CLOSED! Don't let them bother you... have you tried to make payment arrangemwnts with them before you closed the account?
I'm not the best one from a PDL perspective but from what I understand soem Storefrons are registered somewhere and have to make arrangements with you if you go in to do so before you default. I would think that either way they will want to work something out with you in order to recover some of the funds.
You can count on one thing though... I know my banking pretty well :)

Egypt, my heart goes out to you! I'll go beat them up if you want, although I don't think I'm very scary looking.

You are making me laugh hre Mom...but ya know I think the plane fare for you to come here might be a bit much.
I just got off the phone with the first gal who said she did this...you know this may be what they are trying now? Because two have done it? She is going to talk to her manager to see if they can take payments or if it will be sent to collections. SENT TO COLLECTONS.....could have done that in the first place? No? They may all go there and I will be out of this in about 6 years...LOL
Then I went to the mail and got a notice from another threatening legal action? if not taken care of in thirty days?

Just remember that THEY CAN'T EAT YOU!
Most people want their money, which is understandable, and will work with you to get it back. Just make sure that if they make arrangements with you that you agree to something that you can afford. If the one that sent the letter is a storefront I would call them right away in an effort to set up arrangements which will let them know you want to take care of the obligation. Legal action would cost them money so they should want to work with you!

Angell hit the nail on the head...who cares if they think you are a "liar"?? These people are relentless and shady with zero integrity! And they have the nerve to call someone else a liar.
Do not let these people affect you personally...they are scum and not worth your precious time and energy.
payday loan nightmare
i feel the same way i had to close my checking account. i have a total of 12 payday loans out there and i can only pay one at a time of course these crooks don't want to let me pay them off one at a time
but if something happens to me from all the stress i am under then NO ONE WILL GET PAID.
How true that statement! Its not worth risking your health over.

Well, I am running on reserve now. I have adrenaline to spare evidently...no sleep, no food, constant worry...but I am determined to get out from under this. I have come *clean* with the important people...my family, my work and bank....if they are supportive of this effort, what more can I ask for? (Other than a million to pay them all off...I'd settle for a few thousand?)

we're here for you too egypt!
All of us here have walked in your shoes at one point when dealing with these PDL's....its that initial panic and stress once they start calling. You will get a thick skin out of all of this.

I sure hope so VBM...I am gonna need it, I can see. What burns me is that they are being such jerks and they know I have paid them back many times over. One was cool today though...she said come in my next payday and set up what I can pay and I do not think she is CFSA....so she belongs on the plus side with two others. I have had The three that are jerks and the three that are cool.
One of my bank managers warned me today about only agreeing to what I can pay when I make these agreements. She is not sure how these things go but said if I went to court to document everything (yes Cannr) to keep a journal of all these events and attempts to work out a payment plan with them, etc.

I'm sure that a bank is probably allowed to tell a payee of a check whether the payor has enough funds in the account to cover it.
But the release of any other information is protected by financial privacy laws. Your bank could not tell them the balance in your account, or even if you had another account.
I don't get why she thought she could get a cashier check - if there's no money in the account, end of story. Or was she trying to get a cashier check drawn against another account you have there? A bank definitely could not do that.
egypt has been begging these storefronts to make payment arrange
egypt has been begging these storefronts to make payment arrangements! They are being a##holes. egypt, please do not pull your hair out or burst into tears. These storefront managers you are dealing with are ruthless. But, that's okay. Your bank account is closed. They can't do shit with those checks they keep walking in with. And, believe your bank. If they tell you they are not "helping" these a##holes, then they aren't. Let the storefront managers walk in every single day (guess they have nothing better to do). Whatever gives them a thrill. The account is closed. They're not going to get shit. And, let it ride, egypt. They'll tire of playing with you and move on to the next victim. Let them turn you over to collections. PLEASE! At least this way you can make payments and not be harrassed on a daily basis. Good God Almighty! Remember:
What can they do? Turn you over to collections (make payments) or take you to CIVIL court (make payments). So, let it ride. I know I make it sound "simple", but I do understand your anger and frustration and shock over all of this. But look at it this way, if they turn you over (and I wish they would and just get it over with), you will no longer have to deal with them. You can make payments, egypt. You're not going to get hauled off to jail or anything. That's the thing that bothers me about your storefronts. What the hell are they putting up such a friggin fight for? They're going to get their money. They know they are. So WTF????
Hey guys, I am at work right now... I got here tonight and the H
Hey guys, I am at work right now... I got here tonight and the HR gal had left me a note to contact so and so at one of those two PDL's that tried to get a cashiers check...and here is the thing with THAT...the bank will not issue them a cashiers check on ANY account if it is made out to a company which is what the teller first told this one woman...then, before they even had time to tell her that there was money in the account or it was closed she made that reply, "Oh I know the money is there" and flounced off...this is what she told her district...that the account was open and the funds were there? Then why not send the check through? This one has known for months that I had problems with my husband being out of work, etc. So why would I lie to her? Why would I put myself through this? Hey if I have to I will call above them both and go to the corporate office?
egypt, I don't understand the reasoning behind these storefronts
egypt, I don't understand the reasoning behind these storefronts. Like you said, why aren't they attempting to send the friggin checks through? Why all this about a cashiers check? Whatever. They are just totally retarded as far as I'm concerned. Maybe they're trying to see if you do have a new bank account. And, so what if you do??? They can't do shit with with. The checks they have are from your closed account. They can't go in and cash them through your new account even if they knew you had one. So, to me, they are complete idiots. Hell, I would have called the corporate office WAY before all this happened. If you decide to call the corporate office, go for it. These guys are insane. Honestly. Nuts. If you don't want to call corporate, then let the you-know-what's just turn your butt over to collections. Let me ask you a question, egypt. Do you live in a small town?
Oh-oh... not really small, but some ae right across the street f
Oh-oh... not really small, but some ae right across the street from one another. It would not take much for them to check with one another?
Please tell me that you do not think this will get me in more trouble?
I will send you a P.M.

Oh egypt I wish there was something I could say or do to make this better for you. Know that everyone here is in your corner.

Thanks people...I cannot imagine that one customer is such an issue with these people? Or that they are so stressed about the collection on one person? Arghhh....why just cut through to the chase and set up arrangements with me?
One called to today for me to call them back...all she was suppose to do was tell me what the manager said...I am sure it is going to be to pay the entire amount.

Okay, the latest...I got a certified letter from one of the storefronts that they were unable to reach me and resolve this matter...I have called them back...that the district manager says it is a federal law that I must be current to make a paydown agreement and that all I have to do is borrow money and rewrite to get this paydown...On a closed account I asked.
The letter does say they will turn me over to their collections dept.
I have not yet heard that it is a Federal Law that the loan must
I have not yet heard that it is a Federal Law that the loan must be current for them to receive payments or a paydown arrangement. This sounds like a crock to me and I think that she knew it when I asked her to send me proof of this. She told me she was just giving out the info. her job required of her.
Egypt, that is news to me too...maybe someone else will know bet
Egypt, that is news to me too...maybe someone else will know better but you would think if it is true, they would be able to tell you waht statute it is and where it says that in your contract. I would think it easier just to go to collections....atleast you do not have to deal with these idiots any more.
I called after I got the letter and she asked and this is really
I called after I got the letter and she asked and this is really priceless...if I was in debt, why did I borrow money>...... I mean WHY else would one borrow money...just for the heck of it?
I told her I had taken this out a couple of years ago and our situation had worsened not gotten better.
