I am paying 4 different collection agencies, $50 per month. My first check in December stated to each that they would receive a min of $50 each month until the debt was paid. Since then, I have had no letters from them, nor have I talked to them, they call, but always when I am at work and they never call my work. Would they have already notified me if they were going to sue? How do I know if this is the wisest course of action.

I just want to be sure I understand what you're saying. You wrote on the check itself (like in the "memo" portion?) that your payment arrangement would be $50 per month until paid off?

If that's the case, I would say I'm not sure the collection agency would even take notice of a note like that on a check, because most of them use payment processors that don't even take time to read the memo on the check, provided there's a payment stub from a statement enclosed with the account number on it. They simply apply it to the account shown on the payment stub.

Thank you for replying. No I sent a note with each check telling them that I would be sending a minimum of $50 each month until I had paid the debts in full. That was all of the information I gave.

Nana -

You might want to answer at least one call from each collection agency (or whichever one is calling) and make sure they understand your intentions. The majority of collection agencies will accept pretty much whatever they can get in the way of a payment arrangement, but they may not have seen your note or it might not be noted in your account that you sent the note in.

Just to be on the safe side, I would go ahead and make sure (verbally) that they realize what you intend to do.

Thank you very much. with everything we have been through the last 18 months, I don't need someone suing me and adding extra fees to what I already owe.
