Why Hire an Attorney

There is an old saying "The person who goes to court alone has a fool for a lawyer." This may not be entirely true in some cases but the majority of us are not equipped to walk into court with little or no experience and think we know all the tricks and traps that await.
It has been exactly one year, shy one day, since my joining this site. I have read countless posts on how to "move for a vacate with prejudice" if the other side doesn't show up. I have seen a great deal more where they have shown up and the self taught was railroaded into paying an inflated debt plus attorney fees and court costs.
I have heard nightmare stories, and experienced some personally, where people are harassed night and day with threats and misrepresentations. If you have a headache that won't quit you go to a doctor. If your car needs repair you go to a mechanic. Why then when a persons quality of life is being destroyed by the sociopathic collector do they just try to deal with it.
There are many law firms out there that are eager and caring and willing to work for a portion of what they can win while stopping all of that aggravation. If it does not cost out of pocket why not take advantage of it? If you were harassed a year ago it does not matter. You were still harrassed and your right to life, liberty and the pusrsuit of happiness was taken illegally.
Yes a debt validation letter will temporiliy fix a problem but it eventually it will come back.
If I had this mind set a year ago I would not have had a judgement against me. I would not be having spikes of hypertension and many sleepless nights.
The National Association of Consumer Advocates is there to help you. Why do it yourself?


Frogpatch, I respect and agree with everything you are saying. I would love nothing more then to have to resources available to hire an Attorney, or find one that will work on a contingency basis. I have called many many Attorneys, and so far have not been able to locate one that is willing to work on a contingency basis. I went to the NACA website, and called some of the Attorneys listed in my area, so far, no luck. In fact, I spoke with the receptionist yesterday of an Attorney which was listed on the NACA site, I gave her some information, asked if the first consultation was free, and she said no. Anyway, I left my name and number, and they never called me back. I am not in a position to hire an Attorney, if I were, I wouldn't be in this predicament to begin with. :?

Shazzers, what state do you live in? Are you trying to hire the attorney for fdcpa violations? I actually got mine from a post on this site by someone else who used him. He did say there are not as many who do what he does compared to accidental injury attorneys. I will try to help you find someone if I can.

Frog, I couldn't agree with you more! I know if I attempted to represent myself in any collection issues in a courtroom setting, I would have my @$$ handed to me. If I ever get sued again, I'm definitely going to have to retain an attorney, I used my local Legal Aide office before and will probably have to do so again.

And Shazzers, I really feel for you in your, apparently, fruitless search for an attorney to represent you. I hate to admit, your situation probably isn't all that far outside of the norm. I'm sure there are hundreds of people that are abused in the court system daily because they couldn't afford or were unable to find legal representation. Like adequate health care, adequate legal representation has become something available to a select group of people with the money readily available to afford it.

I guess sometimes Justice isn't necessarily for all.

Hi again, I was actually sending an email to another Attorney I found on the NACA website, it will be interesting to see if he responds. Anyway, I live in Ohio, and have called several Attorneys, including legal aid, of course legal aid is backed up until 2011 so that's out. If you would be so generous to help me locate one, I would be forever in your debt. My time is running out, I have a couple of cases pending right now which needs responses to these summons, and discovery documents. I am almost 100% sure that if an Attorney represented me, they would get some moola out of these, I have kept very good records, and based on some of the things I have read here, there are definate FDCPA violations involved.

well, I just hired a NACA attorney, just met with him this afternoon. We have two cases we are filing against two different CA's. Contingency basis, frogpatch, just like yours, and the guy was really cool about everything. I spent three hours in his office and he didnt care about how late it got--he sat there until I got up, until every question I had was answered. And, when all is said and done, I dont have to pay one penny for his services--

if we win, the CA that we beat in court will be paying his fees.

if we dont win, then he takes the loss and charges me nothing.

seriously folks, when you can find that kind of deal, what do you stand to lose??

What about in PA? There IS an attorney, who does the "if we don't win, you pay us nothing." However...he is an injury lawyer. DARN!!

GUESS WHAT!!! I have an appointment to see an Attorney on the 24th of April. His receptionist actually called me back and he agreed to give a free first consultation. Well, it's a start! I have no idea if he will work on a contingency basis, but it doesn't hurt to ask, so, we shall see.

Wulf you gotta get out of the green mountains! There is too much snow on the roads for you! If you don't own an antique store and you don't ski, what are you doing there? I love Vermont but not year round! How many pancakes can one person eat?

Well that's super! I just hope this Attorney I am going to see on the 24th will work on a contingency basis. One thing I find interesting, when I was talking with his receptionist, she seemed very interested in hearing more about Merchants Credit Guide. I can tell you one thing, I have all the paper proof I need on that company, they continued attempting to collect during the time I was asking for validation!
