NCO and American Express

For the last few months we have fallen behind in our bills (medical and lost jobs) and even though we tried to negotiate with American Express, they sent our account to the "famous" NCO.
From what I have read, they do not seem to be the nicest people to deal with. They call day and night, they are rude, and totally unprofessional. A couple of months ago my husband finally talked to a nice guy that gave him a break and allowed us to make $200 payments every 15th of the month. Well, that just lasted 2 months, and now, they are back at calling asking for their payments. It is not even the 15th and they are calling!!!!
But this gets better, this week the person that called my husband said that now we had a balance of $3,100, when we have been paying $200 for the last 3 months and they are not applying it to the balance!!!
Can they do that? This "person" told my husband that they will continue to add interest charges to our balance until it was paid in full. Are they allowed to do that???????? :evil:
I think they are FOS. Is there a letter that we can send them first, asking them for the exact terms of the agreement, because we do not want to be paying additional fees, and ask them to stop calling my husband at work.
I do not know if the "cease & desist" letter applies to this case.
Any suggestions are always welcomed.

Send the C&D letter immediately by certified mail. I personally am having a suit filed against them for numerous fdcpa violations. They are the worst! They called me after receiving th letter a month or two later like they forgot. They never validated the debt. If you can get an attorney to handle this on contingency it may pay off in the long run for you. They may wind up owing you more than you owe Amex.

Yes you can put both into one letter. there are several samples out there and you can see some on the 'do it yourself' section. This is the perfect example of why a DV is so needed! You want to make sure that whatever they are charging is legal, I can't see how making $200 payments every month and not a penny of it applied to the balance? That seems suspicious to me.
