Prior Debt Consolidation and Divorce

This topic has probably already been answered, but here is what I am dealing with and I am not sure what to do at the moment.

I am in the process of a divorce, my ex-husband has refused to pay any cc's with my name on them, about a year ago, I moved out of the family has (he still resides there), I placed the cc's on a debt management program, but took it off in June when I lost my job and was not able to make the payments. I have not paid on any of them since June of 05. I sent each cc a letter stating that the cc's were under joint property due to divorce, ofcourse they are still hounding me, I got to the point where I just changed my phone number. The total debt is about 6,000.00 (original), it's up around 8,000.00 now (ofcourse).

Now that I am working again, I want to place these on a debt consolidation program but the ones I have contacted all want too much money, I understand that the cc companies are all requiring double payments now, since the banckruptcy rules have changed.

While we have a tentative Property settlement agreement, I am still going to be left with he 8,000.00 in cc debt, I am not getting more than 10,000.00 in cash from the divorce settlement,the rest parital 401k that will have to go right into an IRA (so I can't use that to pay off these debts).

My alimony is going to be about 400.00 less a month than my Spousal support is, plus I will be losing about $175.00 in child support in Feb due to one child turning 18.

I am just restarting back into the work force, as I stated I am renting a place for my children and I, given that I have been using the Spousal Support and child support to live, and only being about to make about an additional 800.00 a month, that leaves very little in extra income.

I am half tempted to just let these cc's go, in other words let the be written off in the future, one cc has already gone to a collection agency, another is on it's way...

As I check into other debt consolidation companies, none of them are able to get my monthly payment down past 300.00 and I cannot afford that at this time, even with the settlement in hand, I am not sure that it would benefit me to put these one a dmp.

Do I have any other options, or do I have to wait until the divorce is final...something (my gut) is telling me to wait it out until after the divorce decree....

Welcome back to the forums.

As you have already taken a consolidation program earlier and missed the payments in that program, the creditors are finding it tough to offer any benefits to you.

Also, your credit report is getting worse as your accounts are heading towards collections. So, you might be facing difficulties in acquiring new credit in the future.

At this point of time, if you wish to keep your credit file in present shape or do any slight improvement, you will have to contribute large payments to your debt account. You might do it for few months so that the creditors give a good view to your file. Later, you can take a consolidation program so that the consultant is likely to offer you lower monthly payments.

Based on your previous record, you have to put a good view in front of your creditors by offering large payments. This will smoothen everything in the later stage.
