I have the following:

MK Marketing LLC aka edollarsdirect.com aka midlandhobbysupplies.net Loan amt $300; paid to date $990 in fees (Sent an email to them on 2/12/08 advising that I wanted to payout..my email ignored...I have 4 different phone numbers and 3 different fax numbers for this place...I cannot get an answer to any of the phones when I call or fax)

USFASTCASH.com Loan amt $400; paid to date $120 in fees

No principle on either.

As indicated in my subj I am in NC. I sent an email inquiry to my state's AG complaining that I cannot get a response from MK Marketing LLC and asking for advice. I cannot close my checking account and open another account (checking or savings) because my paycheck is on direct deposit and my HR is very slow correcting direct deposit information. My next payday is this Friday.

Can I have a stop payment issued on USFastCash and on the MW Marketing/aka/edollarsdirect/aka/midlandhobbysupplies.net? Also use the revocation letter w/ copy to my bank? I feel like such an idiot...I'm close to not being able to make my mortgage payment. I don't understand about debitors being about to take 3 times the amount of a stopped payment check or being able to take the full amount of the loan out of my checking acct since that is not stated in the loan (illegal) documents. Thanks for any and all advice. I really need to know the steps I need to take.

Sky, I think someone else posted an answer fo ryou on another thread. Ask your bank to place your account on deposit only status or place a hard debit block on your account. THis will allow money to come in but no to go out. Do not send the letters until your account is taken care of. That is your first priority. Please read this about closing your account, there is good information in it which you should know before you contact the bank.

HEre are You will find the Payday loan laws North Carolina here (just select your state),
http://www.debtconsolidationcare.com/paydayloan/explain-pdls-laws.html

What this basically means to you is that the your pdls are prohibited in your state.

I know this mess is mainly my fault, but so much really bad stuff has happened in the last few years that I was pretty desperate....I'm broke, hungry and scared. I'm really scared to close my Wachovia acct..they contributed to this mess; collateral damage so to speak and they have been nasty to me in the past when I tried to talk to them about my checking account.

You're not alone, we all make mistakes, please don't beat yourself up about this, just continue being pro-active and remain strong, hopefully things will turn around for you soon. I wish you the best.

Also, guest, you can open another bank account somewhere else. We have a "banking forum" on here also. It lists out banks by state that will open accounts for people who can't get accounts with banks for whatever reason, okay? Don't worry. You can open another account somewhere. Go to the banking forum and MCA can help you out. Check out that forum and look for your state. MCA has them listed out by state. If you need help with it, let us know and we can help you.

Do not be scared and alone. You have us now. We will help you.

Sorry! It's on the first page, just down a bit from the Get Out Of Pay Day Loan Help. It's called Banking Help And Using Chexsystems (or something along those lines. My mind isn't awake yet). But, I'm posting the link to the banking forum for you. Just click on it. :D

Ok...I've printed off reams of information from this community. Ducks are all in a row and guns are loaded for pdl hide. Appl sent to credit union for new account; ready to go do the hard block/close thingy on my current cking acct.
I have two questions...since I am in NC and payday loans are illegal, do I pay interest/fees on principle or not? This is one point I'm not clear on.
Also, do I fax, email or snailmail the letters to all parties involved or do I fax, email AND snailmail the letters?
I can do this...I can handle anything they want to throw at me. The only thing I worry about is someone calling my employer or my references. thanks, dr (skymerle...having problems getting my login straight)

sky, only agree to pay the principle amount of the loan. Only what they deposited into your bank account, okay? No fees, no rollovers, no illegal fees. Principle amount only. Also, if you have fax numbers, email addresses, and mailing addresses, send the letters EVERY SINGLE WAY POSSIBLE. When you actually mail the letter, send it certified so that you will have proof that they received it. Fax it and email it also. Send it 100 times a day if you have to.

Cheers, my friend! You stay on them! USFastCash is a ****. I'll tell you that right now. As long as you didn't go over the principle amount, they can pretty much kiss off. EDollars - stay on their butt for a refund of your overpayment. I'm cheering for you here! :D

Sky here again...a few more questions

When I do the 'hard debit block', my direct deposit paycheck will go into my account correct? Then I can close the account and get my paycheck funds correct?
So I can do the 'hard debit block' tomorrow, then close my checking account Friday?

I have my insurance prems drafted from my checking acct, but I've already contacted them and I have their email stating they will not draft my account end of April.

Thanks again, sky

****y.

I checked my records...I paid USFastCash $120 on 2/29/08, $120 on 3/14/08, $120 on 3/28/08 and $120 on 4/11/08. Well..looky there, they owe me $80 dollars.

Fool me once shame on you. Fool me twice shame on me.

sky, you're NOT a "wimp"! You have NEVER been a "wimp"! You were taken advantage off. Push for a refund on USFastCash; however, I will tell you again, they will be a ****. I was lucky to get a PIF letter from them (through my AG after MONTHS of fighting with them) and I had overpaid my loan. Hell, by then I was like "forget about a damn refund, I'll take the pif letter"!!! I'm glad we've given you courage! That's what we're here for! To help you and to also let you know that there is a way out of this nightmare! Whatever you need, just let us know. We'll be here to help you!

Skymerle here....

Well..I did it. Although my stomach is still in knots
and I sat in the bank's parking lot for 30 minutes, I finally went in to the bank and I did it. I spoke with the branch's asst manager, a Mr Allison...he handled it a little differently. He did do a ach-stop pay block on both the pdls...at no charge. I am to go in tomorrow to set up a new cking acct (free) that he assured me would not be linked in any way with the old acct that will be left to sit, void of funds but with ach-stop pays, on both company ID#s, be good for 6 mths.
He told me each pdl lender has a company ID # and regardless of the varied names they can use (easy to do), it is difficult to get multiple company ID #s.
I still wonder what's to stop a pdl from sending a debit to an affiliate pdl with a different company id # and that debit going through my old account. I guess since the bank has the ach-stop payment/block
on the acct now, if they let it go through, they have to reverse it and refund any nsf fees.

So my next step is to write the letters with copies to the NC AG, BBB, NC Banking and FTC...right? Email and regular mail certified right? Then file complaints directly with the NC legal entities and BBB? I'm a little weak in the mind right now.
Thanks, sky

sky here...

Excuse me while I go to the bathroom and throw up......

Ok, I'm back. For sure you know that one pdl lender can have multiple company id #s? Not to dispute your word, I just want to understand completely. My acct now has the ach-stop payment block on it for the 2 pdls...what we do tomorrow with the current acct I'm not sure of, but I will make certain it is either closed with stop-pays good for 6 mths or a will insist on a hard debit block. Will this work? Even if they try to send a debit back through with a different company id #, it will take more than a day...they shouldn't get the stop pay notice until Monday right? I have to get the new acct set up for my direct deposit....actually, I did send in an appl to a local credit union Wednesday so I might end up with 2 accts to choose between for sending my paycheck to directly. Wouldn't trying to send back through a debit with a different name & company id # be fraud?

thanks, sky

A debit block will stop anything from going through, unless it's putting money into the account. Nothing can come out. Even if there was money in there you wouldn't even be able to withdraw without removing the block.

The problem with the stop pay on the ach is that payday lenders are used to them. It will stop them for a bit - But depending on the company, yes they do have different id's, and/or they will just send through a check, which will circumvent the ach stop pay.

Using a different company ID would not necessarily be fraud. If the same parent company owns both subs, then it's all the same company anyways. But each company will have their own id#, bank accounts, etc.

When you talk to the bank, ask them about freezing your account. If they still say no, ask them what they do when they find out a customer is using their bank account for fraudulant purposes. The answer? They freeze it! They put a hard hold, or a freeze on the account so that it can no longer be used. Don't take no for an answer.

Skymerle here...

Ok, checking account is closed, new account is open.
I was assured that there was no way any pdl would forced open the closed account with either an ach or a check. I was assured there was no way my old account would be linked, in any way, to my new account...no way. Everything is documented for any processor to see. The $30 stop payment fee was waived, new checks cost waived..have new checks and dr card coming next week. This was Wachovia...a bank to consider, and my credit is not the best.

btw, I am also asking for refunds of any overdraft fees caused by the pdl...this will be in addition to overpayment interest/fees they sucked out of me.

I prayed to my dad in heaven to help me get out of this mess. I think he did help me..he guided me to you guys. Thank you. Sky

Now the fun/fight begins...ya hoo!!!

Sky here....

I recd a phone call from one pdl this morning...didn't speak with them, but I know it was in response to their ach block on my account.

I also recd an email from the other pdl in response to my fax...nothing said about the ach block. Wanna read the email?

I also told both pdls that they never disclosed to me the fact of their not being licensed to do business in my state making their loan operations illegal.

sky here

...edollarsdirect in their email to me admitted to being domiciled in another country, and that on pg 4 of the contract they state they are outside this country. I have every piece of paper they emailed to me and there is no page 4. New tactic...add documentation after the fact?
He also said Aaron explained everything in detail to me over the phone...it was a 5 second conversation. The details were extensive...

Has anyone considered mentioning these guys to their state's internal revenue service...states sure are missing out on a lot taxes. I wonder if these guys paid taxes in the state they say they are domiciled?
