My husband had cashed an insurance check that was sent to us by mistake. Now we obviously owe that money to the hospital. I have been making monthly payments to them, but they are not satisfied. They want the full amount of the insurance check plus $500 a month for the balance. What can I do? They basically want $3700 up front. We are living on one income which is about $1200 a month after taxes.

Well, let me ask back few things....

What's the total amount of the bills? because under any circumstances you only owe that much to the hospital and not the entire amount of the coverage.

What's the amount issued by the insurance company? I mean they definitely had an adjuster to evaluate the total cost before writing the check.

If your medical bills and the check written by the insurer both bear the same amount, then you have to pay the whole amount to the hospital. Otherwise, pay them what they owe.

Regarding the $500/month, ask them back what its for..sorry, I don't think they can charge anything unnecessary.

The total is over $14,000. The check was for $3200. Which I know we owe, and have been trying to pay back. bUt the lady from the credit company told me its not adequate. She said unless we pay the $3200 they will turn this over to go to court. Can they do that if I am paying? I know now the check was suppose to have been giving to them, but my hubby didn't know when he cashed it that was what it was for.

I believe and I may be wrong here but I think they can still try to go after you for payment regardless if you are paying them back or not..someone will be along shortly to advise further...however if they do it will look good in court to the judge that you are willinly paying them back.
