i need help with payday loans

OK here is my situation. I live in ohio. I have 3 store front loans which i know are legal. One at checksmart for $600, fee $87.50, and one at Express payroll (checksmarts sister companY) for $550, fee is $81.50, both of these loans are were returned by my bank so are delinquent, and they are telling me that i have to pay it by this friday may 9, and i cannot make partial payments of any kind it has to be the entire amount. I also have another delinquent loan for $500 fee is $75 at another store front company called always payday, no one has called me from there yet, that i am aware of. I also have several online pdls. I have one from impact cash for $300, fee $90, so far i have paid $360 (90 every 2 wks, 4 times). I have an online loan from mte financial, also for $300, fee $90, i have paid them already $735, i have one with cash banc(online) for $500, fee $140, i have already paid them $670. I have one from 247advance.com for $200, i do not know what the fee is, but i have already paid them $212 ( i think), i also have one from fastcash.com but they call themselves something else on the debit from my bank acount and that laon was for $300, do not know the fee, and i have already paid them $419 i think, i also have one with geneva roth ventures for $300, fee $90 have only paid $90, and one for usapayday.com for $300 fee $90 have not paid anything yet, they were returned by my bank. so what do i do? and how could i find out if they are licensed in my state or not (online pdls), and how do i go about getting my accounts cleared if they have already been overpaid, which from reading some of the other info in these forums, i beleive they have. I would appreciate any help or insight i can get. thanks.


Well thanks for listing your state that will help alot. Someone will be along shortly to post your laws hang in there.

You need to find out if any of the store fronts are members of the CFSA (I think that is what it is called) and you can do an extended payment plan (EPP). There are several people on here from Ohio and will help you. :lol:

Is this correct? I am assuming you have already defaulted on the store fronts?
How much have you actually paid each of them?

Store Fronts
checksmart for $600, fee $87.50

I hear all these nightmare payday loan stories and it makes me sick to my stomach. I can truly say that I know exactly how you feel. My story isn????????t too much different than anybody else????????s out here. But I want to share this with you because there is hope out there. I make decent money, not great money, but not bad considering the current economy. I bring home 1650.00 every other Friday. I make enough to pay my bills on time and have approximately 150.00 cash left over per week for spending money. It only took 3 months for the payday loan trap to take me down. I was leaving for vacation and needed to take a little extra cash. I went to a store front payday loan center and was immediately approved for 800.00 cash on the spot which was payable back in 2 weeks at 912.50. No problem I said, it was like a gift, I was thrilled.

I was thrilled until I got back from vacation and realized my mortgage was due. Now I owed 1300.00 for the mortgage and 912.50 for the payday loan. Well obviously my paycheck wasn????????t going to cover that, so I went and got another store front payday loan to cover the one that was due. So now I was juggling 2 payday loans and all the interests. In order to pay my bills at home which I could easily do before I was paying all this interest, I had to take out more payday loans. Then the interest started cutting more and more into my spending cash for my family. So I needed to take out more loans. Surprisingly everybody approved me. Before I knew it I had 6 payday loans outstanding at 912.50 a piece. As you can see, I now owed more than I was making. I was truly standing in quicksand with no way out. I needed help.

I contacted all the companies and attempted to make payment arrangements. Nobody would work with me. The best they could do was a 2 week extension. Then what? I????????m right back where I was before. Then they started calling non stop, at home, at work, on my cell. They would threaten to garnish my wages. It was horrible.

I called at least 8 different attorney????????s and nobody could, or would help. You see the contracts we sign are iron clad and it????????s a huge effort and a lot of money for an attorney to battle it out with a store. Not to mention there????????s no money in it for the attorney, so they can????????t help. I started looking online and making phone calls. Places could help with online payday loans or credit cared debt, but nobody could help with store front payday loans. Now I????????m getting really nervous. I wasn????????t asking them to forgive my debt. I just needed a reasonable timeframe to pay them back. You can make all the calls and file all the complaints you want, but in the meantime they are harassing you at home and at work all day long.

It????????s scary to see how much power these payday loan companies have. Nobody can really escape them once they get you. After dozens and dozens of phone calls, I finally ran into somebody that might be able to help me. He knew a bunch of owners and former employees of these places and he really understood how the collection process works and what they can and can not do. He only charged me 200.00 for everything which was pretty good considering what the credit relief places where charging. He was able to negotiate a 12 month payment plan less than 70% of the principal amount that I borrowed. I now pay 129.00 per pay check, which is a lot, but it????????s a whole lot better than 3000.00 per paycheck. Although this nightmare will continue to follow me for the next 12 months, I feel blessed that I can at least afford my payment plan he set up for me. I now know that there is a way out. I don????????t feel comfortable leaving the cell phone of the gentleman that helped me without first getting his permission. But his email is Removed by Shazzers, email addresses are not permitted per TOS rules. Considering the amount I owe, and the options available. I feel pretty good about the help I was given. I wish there was more help available out there.

Hello Chris, I'm sorry to hear of your misfortune, however, if you are from Ohio, and I am assuming you are since you chose to post in this particular thread (and even if you aren't) it's too bad you weren't aware of the EPP (Extended Payment Plan) per CFSA guidelines. Of course that is providing these store fronts you were dealing with were members of the CFSA. The guidlines are as follows and set forth to Payday Lenders who are members:
Customers who are unable to make their payment in full upon the due date can evoke the EPP plan, which means your loan would be broken up into 4 separate payments on each payday, but store fronts will not offer this to you, YOU have to ask for it. You must request it prior to defaulting. Most people who are involved with these lenders aren't aware of this.

I was just wondering if anyone else noticed the contract it self. (It states that I have 60 days and should be provided with a consolidation source should I not be able to pay.) I became unemployed when my workplace closed. I applied for unemployment the next week, but not only does it take two weeks to get it, it is only for one week the first time. (I've never applied before) I had been paying my phone bill and putting money in my bank account which was overdrawn. I had no idea they didn't pay check smart because I didn't use my account after I saw that it was negative (it had marked that it was withdrawn, so I thought I only needed to pay back the bank.) When I started getting harassing calls I tried to explain. When I said I became unemployed they said "who's fault is that?" I wanted to say "the president's" but instead I said "not mine, honey, or I wouldn't be getting unemployment!" She called me, "Nasty" and hung up on me. I was going to tell her I had $20 dollars cash that I was going to money order her but I instead just sent it there with a note saying I was doing my best and this is all I could do at this time. I just read about sending a letter requesting mail contact only, and I think I'll try that. I do intend to pay and hope to find a job with in the next month (I go back to a winter seasonal job in October but I know they won't wait that long.) But I have had to move back into my mother's and really am struggling till I find a real job again. The unemployment pays less than half what I made before and I was already a month behind, which was the reason I took the loan in the first place. My car had broke, and I had to get a new used one, which took all that I had saved specifically for the slow summer months when it is hard to make a decent wage anyway, but I didn't expect to go to work one day to find the doors shut!! Any body got any suggestions besides the letter? oh BTW I'm in Florida sorry...

You can try to block them with your bank, but if they change hte name or withdrawal amount then it will still go through. The best thing would be to close your account & then let them know that you owe them money & want to pay them in another way.

How much did you borrow & how much have you paid back in fee's? If you have paid back the amount you borrowed, then you would be done with them and would not owe anything.

Haven't any of you heard of Capital One? Capital One have credit cards for people with several different credit ratings .It is one of a few major credit card companies that have unsecured VISA or Mastercard credit cards for those with no established credit history with low credit limits starting at $300, and can go up to $20,000 if you keep your account in good standing.
