midland credit management/javitch block & rathbone

I recently moved to GA about 8 months ago. I applied for an apartment on 5/1 and got approved with conditions because of midland credit management. The Rental application company said that it was transferred in 12/2007 from Newport News. So I am assuming that they think it was a recent chargeoff because I have other chargeoffs that weren't a problem, I have Newport News on my CBR already and that was charged off in 2002 and was scheduled to fall off 12/2009. I check my CBR through Experian and it has Midland on there for $1490 (intial amount was about $800) and it is saying that the account was opened 12/2007 which is totally false. It also does not list Newport News as the original creditor on the report I saw. I have disputed Midland through Experian; however, I can't get the apartment unless I get proof of payment. Then I get a letter from Javitch, Block, and Rathbone on 5/2 for payment on behalf of Midland whom I never got letters from. I know that the SOL is over, but I'm not sure how to handle this in a timely manner. Any suggestions?

You can find a good template via my signature link (be sure to send the enclosure with it) send it certified mail, return receipt requested. It sounds like they are trying to charge well over any legal interest that might be able to be applied to this debt. I would suggest making them validate first and if they try to file suit in response motion to strike their complaint using the SOL as an affirmative defense and counter sue for $1,000 for the fdcpa violation as well as court costs and attorney fees.
