lawsuit under debt settlement program? huh?

Hello, did you get a summons of complaint? One thing I would advise for sure is to definitely show up in court, otherwise they will get a default judgment against you, and probably have your wages garnished. Anyway, is this the original creditor or a collection agency? If it's the original creditor, you might want to call them and see if you can make payments arrangements yourself, just make sure you tell them that you need in writing what the agreement on the payments will be, and that you can not send any payments until you receive that agreement with them, that's what I would do. Show up to court !!!! Show the Judge your paperwork and that you were working with a company to get this creditor paid. Also bring a spread sheet showing your budget with all your fixed expenses showing you are broke. Even if the judge assigns you a judgement doesn't mean the settlement company can`t settle on a judgement. The settlement company you enrolled with does have an F rating with the BBB and I am sorry that you had a bad experience with that company because not all settlement companys are bad. BUT every one needs to under stand that when you choose to do a settlement program their is a risk of judgements and them should have been told up front to you and I would bet your contract you signed said that.

I have been taken to court by discover card and the judgement was against me. Now they have frozen our checking, savings and kids savings. This have left us with no money for food or gas for my husband to get to work. How can I not file bankruptcy.
