CC Charge Off

Can the company still take me to court even though they "charged off" the account?
The balance was only about 500 dollars and my last payment made to them was in October of 2007.
Actually, I still want to pay the balance because I know having a "charge off" on your credit report is bad.
Do you think I can still call the cc company and work out payments?

call the Credit card company and see if they have sold or assigned the debt to a 3rd party collection agency. If it has than you will have to work out a payment with the 3rd collection agency. And yes they could take you to court , however the balance is not very large and so its not very likely.

They are more interested in getting paid than ruining your credit ... many times you can offer a pay for delete. If the OC still owns it, they might just agree to take it off your credit if you pay them in full.
If they do agree, just make sure to get it in writing. Otherwise if they reneg then you have no proof that they agreed to remove it.

A When a creditor puts a "charge off" on your credit report, it means the creditor no longer believes you will pay the bill and has written the debt off of its books. Often, they then sell your debt to a collection agency that pays pennies on the dollar for the right to try and collect your debt.
While it is legal for them to pursue you, they have to live within the rules of the Fair 1. For more information on the Fair Debt Collection Act, go to the Federal Trade Commission's website, ftc.gov, or log onto http://www.ftc.gov/cp/conline/pubs/credit/fdc.htm for an easy-to-understand Q&A about legal debt collection practices.
