Can I be arrested or sued for failure to pay PDL?

Will payday loans sue me or have me arrested for stopping payment on a PDL? I have 2 PDLs that I have paid on for 4 weeks. Of course this just pays the rollover fees not the principle. I live in NJ and found that PDL's are illegal and all other loans have a 30%cap. I can't sleep or eat afraid I will be arrested or something. What should I do? I faxed them letters and sent them emails stating the money I paid should apply to the principle and then they would be paid in full except for the 30% interest allowed by NJ law.


They are the ones who broke the law for issuing a pdl in your state. The internet PDL you got is illegal and besides the are mostly overseas and can`t do anything to you anyways. This is America , we DO NOT have debtors prisons here. Beside who are they going to get to have you arrested ? INTERPOL ? lol , please don`t let the bone heads bother you . You don`t have to pay them squat and they will have to get over it.

I did not get payday loan. Someone is calling me wanting money or press criminal charges. I live in Virginia. They will not tell me when the loan was made and from what company.

Can they do anything to me and is there a possiblity of someone getting loans in my name?

if you have ever had a pdl however old.these mopes buy info from pdl's and other such sources and try to threaten a cheap dollar out of you.i wouldn't speak to them further.they are a SCAM.do not talk to them they will move on.

of course.they are trained to be that way.just know they are a scam and ignore them.if you get stuck talking to them let them know you know they are a scam and you are reporting them.hang up immediately.

i had a payday loan and did not pay it i was very sick so i missed alot of work .i just went back . and a company name h&p captail called me told me that if i don't pay they were going to come to my place of work . they were very ugly the lady 's name was ms blackwell she told me that i am going to have to get a lawer .if they come to my job they will fire me .i wrok at a persion . she calls me everyday at work and tells me the smae thing over and over

this lady ms blackwell calles me everyday at work and on my cell phone tells me if i do not pay by 4 today they were going to come to my place of wrk . if they come to my work i can get in trouble are fired i been sick and stress out about this .she even told me i better get a lawer. can they put me in jail

I never heard of them, but can you file a police report for harrassment? I've done all sorts of searches, and can't find an address for them, so more than likely they are overseas, and can't do squat, hence the threats. If you do a google search on the number you have, you'll find lots of hits, and same thing has been happening to alot of other people.

Have you told them not to contact you again? And no, you cannot be arrested.

I received another message from the same person. This time he did not identify any company. He said he was Stewart Jackson. He said he filed a PS5. I checked there is no such thing. He said, "Call me back right now!" He then said, "I wish you very good luck. Just wanted to pass on this information. He left number. I checked it and it appeared to be from Miami

I have been getting calls from this place too. Nasty and threatening. I have saved them all. This company has alot of complaints and I even saw one that stated who owned the company, address and so on. Also stated that this person has a lengthy legal history with the state of florida. Why is this place still in operation? They need to be shut down...

Unless H&P Capital is a licensed collector in your state, they can't do anything. That's one of the things a debt settlement company I worked with had told me - unless the collection agency is licensed to do business in your state by your state government, they can't press any small claims issues.

Which of course doesn't mean they couldn't sell it to a licensed collection agency in your state, or possibly get it placed on your credit report (might wanna check that).

After much searching, I have found the legitimate info on this company. I found all of this from the State of Florida website, FLORIDA DEPARTMENT OF STATE, DIVISION OF CORPORATIONS and will paste it in the body here after I explain. First, yes they are a collection agency and nothing more than that. Second, remember that they must disclose their address if requested, or they will be in violation of the fdcpa, but once I post this, it wont ever matter. What you will find interesting, is that they were just incorporated effective as of 10/14/2008. The other 2 interesting points you will find will be:#1 they are in the exact same location as Legal Mediation used as their principal address(and I mean exact ) #2, the treasurer is the same person that was the treasurer for Legal Mediation before she resigned her position before they disolved officially on 10/31/2008. She resigned her position effective 10/27/2008, her name is Tammy Mackey.

can h&p sue me for a loan that was made with chexsmart in ohio? what are the laws. I contacted chexsmart and they said they don't have anything to do with the loan anymore...and that they cannot accept payment. my thought is that they 'sold' the debt for cheap and h&p is trying to get whatever they can. but, CAN THEY STILL TAKE LEGAL ACTION? HELP!

if checksmart sold the debt.then the CA must obey ohio collection laws.they must be licensed or bonded to collect on you.if they are then yes they can sue you,but it sounds like this CA is in FL.i googled there info and it looks like a bottomfeeder CA.use the address above and send DV and limited C&D letters.send them certified mail return receipt.after looking this CA can't sue you without getting a default judgement.theat can be vacated if they don't properly serve you.bottom line don't worry.send the letters,file AG complaints and watch them disappear.

I have recieved calls in Minnesota and the lady told me that something bad was going to happen to me at my job or at my house they said that the guy was a lawyer and she was nasty. They are giving me until wed to pay or else
