BEFORE I RANT AND RAVE---one PDL closed my case IMMEDIATELY-RIGHT FROM THE START-THANK YOU!
well, my other pdls in NC I found out I am on my own---NO REFUNDS!!!NO PIFS!!NO AGS willing to help--actually one emailed me after I emailed him three times and sent a letter and he said CASE CLOSED!!!!NO BBBS WILLING TO HELP--all are closed with them!!! my state ag's office today said either pay them or let them go to your credit report!!! Thats it. I have emailed emailed snailed mail snail mailed snail mailed faxed faxed faxed I have been told theres no more to be done.....I have a collection agency on my case now---I wish I had better luck but I hope and pray that many people get better results than I have......this is horrific what states will do help with illegal PDLs!


I live in NC too. But I have contacted the NC attorney general office. As far as the other AG's office I filed my complaint with their office and I got positive results. You got one case closed.......are they saying that you do not owe them any money? This is a long process.....I would say do not give up the fight. Keep on pressing forward.

one pdl is PIF--they did it after receiving a fax letting them know they were illegal in NC. The NC ag office said this morning either pay them or let them go to your credit report--thats it!!! two PDLs are from one state--the ag considers those loans null and void but the PDLS will not cooperate and are trying to collect $400 each---they are on sovereign nation--so AG can not enforce the null and void or refunds so he CLOSED my case....one is going to collections and using a debt collector to after me and the loan will be placed on my credit report...one is quiet but no PIF and one sends emails once and awhile demanding payment....THREE AGS have closed my cases.

It is a scare that they will use to get you to pay. Please contact one of the Moderators and they can help you. I have a letter that will help you out.
Dear Sirs:


After doing research on internet payday loan laws in the state of North Carolina I have found that your internet payday loans are actually illegal.

North Carolina State Information

Legal Status: Prohibited (N.C. Gen. Stat. ???? 53-281 authorizing payday loans allowed to sunset in 2001)

Citation:
The consumer finance act applies. N.C. Gen. Stat. ???? 53-173

Small Loan Rate Cap
36% per year

I will be contacting the North Carolina Office of Financial Institutions and the North Carolina State Attorney General????????s Office regarding your internet payday loans and your state????????s Attorney General Office and the office of Financial Institutions in your state as well. I will also be contacting the Better Business Bureau and the Federal Trade Commission as well.

I will only pay the original amount that I have borrowed from your company.

I demand a physical address to mail payments to, as you are no longer authorized to debit my bank account. This address must be able to receive certified mail that will be required a signature. I will not remit any payment using Money Gram or Western Union. If a physical address is not provided for me to mail payment to, no payment will be made.

I demand that any contact be made through US Postal mail or email only. I will need everything in writing to keep accurate records of all communication.

I prohibit you or your affiliates to contact me via telephone at my place of employment or my home telephone number. I also prohibit you from calling my references listed on my loan. I also prohibit you to attempt to make any contact with neighbors in regards to this loan. Once I inform you of this, you must stop the telephone contact immediately or you will be breaking the laws of North Carolina.

You are also hereby notified that I am revoking any voluntary wage assignment I may or may not have signed. I will no longer authorize anyone from your company or any affiliates to attach any part of my wages or contact my employer for your collection purposes.

I am revoking your right to debit any checking account that I have now or in the future. You, your company or your affiliates are not authorized to debit my checking account at all. Please be aware that I have informed my financial institution of this situation and they will also be receiving a copy of this correspondence. Any further attempts at debiting my account will be rejected by my financial institution.

I expect a response from your company no later than May 15, 2008, regarding this matter. This response may only com via US Postal Mail or e-mail. No telephone contact is permitted. My point is if you give up then the payday companies win. Keep on fighting and filing complaints.

you said something about a sovreign nation.this might be an overseas PDL.you can dispute that to the credit bureaus,also all they can do is call.i would send a letter to your HR.illegal companies like this might try to push through a flimsy wage assignment.that is revokable.

they can not collect but they can put it on credit report!!!! the NC AGs office stated that to me. They can not arrest me/go to court/etc. they can quietly put my defaulted loan on my credit report and thats allowed by law. I already did all wssu91 said. I was waiting on responses and I got them. I just wanted to update and wish others better luck!!!! I am still sending emails/letters when I can but I have no AGs to help or BBBs--I will have to fight on my own. I will as long as I can.

question,if PDL'S are illegal in NC how can an illegal debt be put on there?defaulted loan is not the same thing.that can be a car loan,or a personal loan.i don't see how an illegal loan qualifies.i would clarify that with the NC AG.

I did I asked her three or four times and she stated that they can be put on my credit report even though they are illegal--THATS ALL THEY CAN DO---she stated and told me to have a nice day(oh thanks for calling, also). I am going to try to do what I can on my own.... thanks for the input....

I have done letters, closed account, and contacted numerous agencies I wanted to update...i will continue using this website plus others to continue on my own to do what I can....it sickens me that states help some but leave others stranded or pdls work with some and others they tell them to go to hell..I JUST WANTED TO UPDATE---best of luck to others who have started their journey with PDLs---ITS HARD WORK!!!! GOOD LUCK!!!!
