The problem I have is I only have my records from my bank for the last 2 or 3 months. I have payed more on some of those but I will Have to dig for those numbers. Ontop of I have payed over the last 2 half months several thousand $ in late fees over drafts return fees. I still have a balance of those that I will paying on my closed account. PLEASE PLEASE Help I dont know what to do.

What this means when we say the company is illegal is that it isn't licensed in any US state. They have no legal authority to lend money in the US. This also means they have no legal authority to collect interest. And no legal means of collecting on the debt. This means you are only obligated to pay back the principal amount, if you have overpaid, they owe you the difference, that doesn't mean you will always get it, but it doesn't hurt to try.

oh no,i need the total amounts paid,if you had these loans any length of time everything that was paid towards it counts,so if you could look at how much paid total.example:if you had a loan for four months and six 60.00 payments were taken,you paid 360.00 into this loan.if the pdl is not licensed to lend you,then all that money should be put toward the loan.

drwheeler, I know this is a lot of information to digest, but the just of it is this, you only owe the principal amount to those companies which aren't licensed. The ones that are, you will need to contact them and work out a payment plan to pay them back, ask them for a physical address so you can send them money orders as payments, never send them a check as they will then have your account number again and use it to debit your account again! You will also need to send wage assigment revocation letters to these comapnies, as well as giving a copy to your payroll department. I would also like to suggest that you file complaints with your Attorney General, BBB, and the Federal Trade Commission against these illegal companies, you can do all of this (file complaints) online. We well be happy to walk you through this. :)

the reason they won't work with you is because they don't want to be paid off.they want to keep debiting your bank account if possible.if they can't debit they will try to push through a wage assignment.that is something that can be revoked by you.shazz is right about that.i would give it to your HR person before sending it to the pdl's.

drwheeler sending these companies a wage assigment letter is a precaution you should take. There are several illegal pdl companies that have been known to try this little trick. It is something similar to garnishment, in the way that they will attempt to send a letter to your employer asking them to deduct a certain amount from your check and send it directly to them. This happens because when people sign up to get a pdl loan these companies sometimes add a clause in there (in small print) stating that if you default, you will permit them to evoke a wage assigment. However, a wage assigment can be revoked at any time as it is voluntary. All you need to really do is send them out to these companies via email, and USPS certified returned receipt, then show a copy to your payroll dept at work. Here is an example:

dr, yes, I have had luck getting out of pdl hell..I had 17 of them and still dealing with some; but for the most part, they have gone away...
Every once in a while, I will get a call or two or even emails. But since the end of Feb when I defaulted, most of mine have disappeared. I overpaid on all of mine. I had two legal ones, which I am still paying on. I just made sure I followed the steps and advise from this community. It really was a life savior. Just make sure you do as they say:
*close your account to protect your money
*send out cease and desist letters to revoke all assignments & to ask for everything in writing
*If worried about phone calls at work; just let them know that you had identity theft and your personal information has been compromised and that you want all phone calls to go directly to voicemail
*STAY FOCUS & POSITIVE

2. If possible either change your home number or get used to not answering anything suspicious that you are not familiar with.
3. Get a cease and desist letter put together and then mailed it certified letter, email it, and fax it to the organization you have the loan with. Again, send the wage assignment revocation letter with this as well.
4. Prepare a payback plan based on what you can afford-and by this I mean what you can afford AFTER you and your family are taken care of; mortgage-rent, utilities, food, transportation. Do not put these people ahead of your own basic living needs.
5. Most will refuse to work with you at all, just keep submitting your offer.
6. Avoid any telephone contact at all whatsoever. These people get abusive, and you will just go round and round and end up getting nowhere.
7. Get tough, and stop letting them make you into a victim. They can't arrest you, they can come and find you, and really only storefronts would even dream of taking this sort of thing to court.
8. Make a record of any and all payments you have made. Find all original contracts and paperwork you have been given.
I cannot stress this enough, these people do not come first when it comes to getting their money. You and your families needs come first-see to it that you do that. Stand tough, if they get ugly, you get uglier.

I live in Ky. and had several payday loans that were online pdls. I was able to get them discharged in bankruptcy. My attorney told me that they could not come after me for bad checks or anything in the state of KY. While the bankruptcy was going on however, they did send a letter to my employer to garnish my wages. I phoned the payroll dept and they stated that they did not recognize a wage assignment from a pdl store because it was not mandatory that they do so. Child support or something like that yes, but not a pdl company.

The only exception would be for defaulting on a government debt, ie, IRS, state taxes, student loan, etc. And in the case of child support, you can be garnished without a court order, since the order normally comes from the sheriff in most states or the Welfare dept if the custodial parent files for it--hence a government debt.
These places will definately try this irregardless, so it's up to you to get that wage revocation order out ASAP just in case.
And in reading your state laws, it says that they are only legal for check cashers only--which tosses out all internet PDL's, since they are not check cashers, right?

Why are you doing that marguiritewhitw have you read the bad situations that can come up with taking a payday loan and how that it can turn into a very bad cycle that is often very hard to get out of. I'm not trying to tell you what to do but if i were you I'd really think twice before taking out a payday loan. You can often end up in worse shape then you were in when you took the loan out.

I have borrowed from 4 on line payday loans during a ruff time when husband was off work due to an injury There was Mte that I got 300 from now says I owe 546. None over $300 on the others. I have paid on all more times over than I care to think about. I am now in a rut can't all at once but have told them I am willing to make payment arrangements. They will not give me address to send the money. They are insisting that I send them via money gram. I had to close my account I am presently also in a class action law suit for idenity theft. I have told each one of them this. What are my rights if any.

They told me that they keep deducting the interest as a renewal & that in order to pay the $200 balance that I need to inform the via e-mail 3 days before due date. Most payday loans renew 4 times & then take the interest plus an additional amount until the balance is paid. Not this company. When I called them & left a message telling them they will no longer be able to deduct money from my account & will be persuing getting my money back they told me there is nothing that can be done by the BBB or AG office because they are foreign held & are not bound by our laws.

that is true.they are not located in this country.that being said.close your account and open a new one.them being in a foreign country also means they can do nothing to you but call and stupidly threaten.they can't garnish your wages.they can't have you arrested.they can do nothing.close that account and when they do call.hang up on them without a word.
