Hess Kennedy Continues Prevailing over Credit Card Industry



CORAL SPRINGS, Fla., June 3 /PRNewswire/ -- Hess Kennedy Chartered
announced that on or about May 19, 2008 and May 20, 2008 there were orders
issued that were favorable to the clients of Hess Kennedy and/or the
Consumer Law Center. The former is a case in Marion County Court, Ocala
Community Credit Union vs. David and Diane Thompson (Case Number
08-2126-SC). The latter is a case in the National Arbitration Forum, Chase
Bank USA, N.A. vs. Matthew A. Berquist (File Number MX0802002044831). Both
cases were dismissed. Hess Kennedy, the Campos Chartered Law Firm and the
Consumer Law Center are all law firms providing services to consumers with
a specific focus on evaluating the actions of creditors and credit
collection agencies and their compliance with Federal and State consumer
protection laws such as the Fair Debt Collection Practices Act, Fair Credit
Billing Act and the Fair Credit Reporting Act.

AGHHHHHHHHHHHH I just made an appt with a bankrupcy atty here in my town. Hess Kennedy got me. Luckily only $900 so far. Another pymt will come out of my checking acct on the 15th. I hope this lawyer can stop it so Hess doesnt get anymore of my money. I feel like an idiot for signing up with them. I have no choice but bankruptcy now. Thanks for the info Tom, I have seen you post but was in denial. The video speaks volumes!!!

Go to your bank and speak with the Branch MGR and have them put a hard hold on your account asap to stop the ACH !!!

I will go to my bank in the morning. What is a Hard Hold exactly? OMG it's all hitting me now. I just want this nightmare done and over with. Any idea on how much it cost for a chapter 7? I have a condo and a car I must keep. Thanks for being here for me everyone!

i just thought of something else. Hess Kennedy will probably try to make with pay for all their "services" since I signed a contract....hmmmm maybe I need to include them in the bankrupcy too.

straycat you do not have to worry about HK at all. Just stop paying them. Tell your bank to stop letting them take money from your account. You don't owe them anything. If you want to feel safe close your bank account and open up a new one. If they give you a bill just ignore it. Call the Florida AG, BBB and the Florida Bar to complain if you want your money back. They are a false company, they have no legal rights to anything.

I don't know why TV has a stronger presentation but it does. I hope everyone sees it.

Thanks again for all the info. Yall are great! I am going to just close my checking account and open a new one with the same back. I just need my mortgage payment to go through first. It should be by Monday. I wish I could negotiate with my creditors but I have 9 of them and now that I quit making payments, my interests rates are like crazy high...like 29% on most. Anyway, I will meet with the bankruptcy lawyer Tuesday and see what he says. update: i met with a bk atty today. i am doig a chap 13. they included hk just in case. i went to the bank and closed my acct and opened a new one with the same bank. i really felt like a dirt bag when i went to the atty office but now, hrs later, i feel like i did the right thing for me and my son. anyway, i will be paying for 5 yrs but will be keeping my car and home. i must say, it was so nice actually answering the bill collector phone calls this evening and telling them i was bk-ing. each said the calls will stop now. anyway, this has all been a learning experience. sorry bout the no caps, typing with one hand while eating dinner.

My fiance and I were doing the debt con. with this company. We had recieved at letter that the company was a scam. Then about a day later we get a letter from an attorney from the state of Florida stating that they are in the process of getting sued. I am glad I am reading up on the company and will got after all the money we have put into this illegal company. We have been paying for almost 2 years at $350 an month and we will do anything and everything to get all the money that is owed to us !!

I have also been scammed by this company and am feeling so overwhelmed not knowing what to do next. After reading a previous suggestion of settling with the creditors before they sell your account I am more worried because I have received a letter from an attorney representing one of my creditors. I don't know if I should try to find a legitimate debt settlement company, or contact the creditors myself. Any suggestions?

I'm in the same boat as you right now. I have a law frim called Weltman Weinberg and Reis breathing down my neck because of how we got screwed. Ill admit Hess Kennedy did settle one of my cc's but the other now come back to haunt me. I will be screwed out of a little over 5k. Guess its karma to me for not being able to pay.

Anyways Send them a DV letter. And ask questions on here everyday. Everybody in here is trying to help each other. Make sure if you start to deal with the attorney you keep records of everything. I was talking to the law firm against me and told them I was sending a DV Letter and they said no we have done that already with your former attorney. So I said I cant? she said no they will not go through that. So I looked a letter they sent me a week earliier starting I could that. So I sent the DV letter along with a cease and desist. Get to know your rights really well. Especially fdcpa. Best of luck
