Sent DV request to Allied Data Corp
Date: Fri, 06/06/2008 - 20:58
Before the DV, the person stated they were collecting for a Macy's account.
I tried contacting Macys, they state they no longer own the account, and could not tell me who did.
So my DV has been sent, and it has passed the 30 days. I have not heard anything from them. There is no entry on my credit report from them. There IS an entry by Macys, with a status of Colldvection/Chargeoff.
Now what? Should I send a second DV, or leave it be? Do DVs ever "expire"? For example, if I do not follow up with a second DV and a 5 or 6 months go by, can they (Allied) suddenly file suit?
What is my next step? A second DV, or sit back and wait?

Have you got the document which verifies that the concerned collection agency has received your DV? If you do, then you can use this receipt copy of the document and dispute the credit report with the credit bureaus.

You may not hear from them; they may sit on it for awhile and then sue you or they might sell it to another collector. As for disputing with the credit report; since the original creditor is the one doing the reporting the collection agency is not responsible for deleting the entry on your report. That would have to be done by the OC and since they have charged the debt off and sold it to a collector, it ain't gonna happen.

Phonix, yes I did get the signed green card back, however I can not dispute it with the credit agencies because this collector is not reporting on my credit report; the original owner is. (Macys) And Macy's has told me they can not help me, I need to go through Allied.
So since I sent Allied a DV, and they are choosing to ignore it.......Can they, a few months down the road, file suit...or must they contact me first telling me they are filling suit?
Should I send Allied a letter stating that since they've failed to respond to my DV letter, all collection activity my cease and desist? Will this cover/protect me?

Welcome to the Community :D When you send a CA a request for DV, they are suppossed to stop all collection activity. This does not, however, mean they will, which breaks fdcpa regulations.
Do you live in Texas? If you live in Texas and a few other states, they have to reply in the 30 day period, otherwise, there is no set time.
What I did with the CAs' was, I did send a follow up letter stating I was still waiting for my DV, and sent a copy of my first letter to them. The reason I did this was, to leave a paper trail in case I had to go to court at a later date. I kept notes of any phone calls made by them during the validation process, and notes on what was said, etc.
If you use the search feature at the top of the page, you can find out what others have done with this company also. Good Luck-keep us posted..karen if they do file a suit against you and have not validated yet, be sure and include that fact in your answer to the courts.

as a side note to bossy's post, if Macy's still shows this as a collection account with a balance owed on your credit report, they are in violation of the FCRA. Once they charge off the debt, the amount they must show is zero, if I recall correctly. You may consider disputing that entry with that credit bureau and see what Macy's does in response.
