Agency trying to collect on a fraudulent debt

Back in March, I had charges on my bank statement in excess of $2400 that I did not make. I went to the bank and filed fraudulent charges and did the applicable affidavits, etc. The bank took 3 months to complete their process, and determined that these were indeed fraudulent charges. Now, this collection agency is sending me letters and demanding that I make payment. I contacted them and gave them the information regarding fraud charges, and the results of the bank's investigation. They still continue to harass me. Recently, they sent me their own affidavits to sign and return to them. I was advised by the bank o have no further discussions with them. However, now they sent me this bogus letter stating that this matter is going before some International Arbitration Review Board, and that I will be responsible for payment with interest,etc. What do you recommend? Is there an agency I can contact to stop this? I cannot afford to hire an attorney to help with this matter. Thank you .

Welcome to the forums. Sorry to hear of the harassment you're having to put up with. I would write one more letter to this company, being a cease & desist letter. The only contact they can have with you is by mail. I would also include in this letter a copy of the banks investigation. That alone should close this matter, saying that the bank was in favor in your interest. Contacting an attorney for a free phone consultation might help as well. They might even been willing to send the company a letter telling them to back off, or legal action might take place. You should be willing to hire that attorney, if the harassment continues. A settlement might even be awarded to you if harassment continues. This would be what you could pay to the attorney if you won the case.

Could you explain more what the charges are for, or what they are saying this loan is from? You mentioned International Arbitration Review Board...is this company out of the company.

Boy they will say anything to try and collect a debt. Don't worry, there is NO SUCH THING. They are trying to threaten and harass you, they are violating Federal law.

    If you filed a police report, then that needs to be updated, and a copy needs to be sent to the collection agency. IF you have not already, file a police report, and send a copy to the CA


    heed Mickey's advice, Contact a lawyer specializing in consumer law. You may be able to find one who will give you a free consultation and may even write a cease and desist letter for free. If not most lawyers get arounf $75.00 or so for a letter. You should be prepared to retain this lawyer if these clowns don't get the message and drop it.


    Contact your banks legal department and see if their is any assistance they can render to you in getting this matter cleard up. This collection agency is clearly trying to continute to perputrate a fraud which has already been committed, the bank will be very interested in that.


    Contact your state Attorney General and Federal Trade commission. File complaints with both.


    Pull a copy of your credit report and check it very carfeully gfor errors or false /fraudulent accounts. If there are any , or this agency has (or their client) has already reported, then you will need to dispute them withthe CRA. To do this you will need to provide the CRA with the results of the the bank's investigation along with any other supporting documentation (police reports, etc).

Welcome to the forums.

You don't have to worry on anything as the bank is favoring your dispute. Ask the collection agency to validate the debt if it is a genuine one.

Moreover, it might have happened that the agency has got in touch with you while contacting some other person. Try to figure out the name of the actual person that they are looking for if it is not you.

If they don't stop their invalid calls, then you should file your complaints at the FTC, BBB and the attorney general office in your state.
