Just a few reminders..Internet PDL

1. It is fairly safe to say, you wll never be taken to court by an internet payday lender. They are operating illegally more often than not, usuallly they aren't even in the US, and legally they don't have a leg to stand on. This information I got from a judge who stated that these businesses are "laughable" in the way they operate.
2. There is no such thing as downloading or uploading-this is a scare tactic because it let's your mind run wild as to what that term could possibly mean.
3. Morally and ethically you should make every effort to pay back what you owe, principal only. You hold the power here and you are able to negotiate your own terms. If the lender will not work with you, that is on them and they won't get paid. Never give them access to any bank account ever again. They will accept a money order, that's it-period.
4. Stop putting your other obligations on the back burner. I am talking about the basics, and we all seem to loose sight of these in terms of importance thinking that the loan "payments" are more important. Pay your mortgage, rent, car, utilities, food, etc. first first first. The other stuff can and will have to wait.
5. You are not at the Payday Lender's mercy, they are at yours-keep reminding yourself of this, and stop letting PDL's turn you into a victim. If calls at work are a problem, talk to your employer, issue a notice to the lender that all calls must stop, because of course, if you have no job due to their calls, well then they can't get paid now can they? Change your home number, or use caller ID folks-that's what it's there for.
These are just some reminders to help you keep your sanity and they always kept me thinking clearly throughout my own process with these wonderful wonderful companies. Hang in there!

-An internet lender CAN take you to court - provided they are licensed and legally lending into your state. Not ALL internet lenders are illegal. There are some who have a storefront (even if it's only one storefront) located somewhere - and that is their home base, which CAN make them legal. You have to be VERY careful when dealing with PDLs to be sure they are indeed illegal before proceeding with guns blazing trying to force them to mark you paid in full and threatening to file complaints against them. A legal, licensed PDL CAN and WILL take you to court if you do not pay them in full - whether they are internet or storefront based.
-Changing your phone number is not the best solution, IMHO. They will simply start calling your references that you listed when you got the loan in the first place. Most of us don't want family and friends to be called because of a PDL we took out. And this tactic is legal - it is not a violation of the fdcpa - and it is used by both legal and illegal lenders alike. The difference is that a legal, law-abiding lender will contact your references and say they are trying to find you regarding a personal business matter. An illegal PDL will call your references and tell them that you owe them money, how much you owe them, and that THEY should pay the debt for you. That's the difference. The legal PDL is simply trying to find you so they can make arrangements for payment. The illegal PDL is trying to harrass you and anyone connected with you into payment. Instead of changing your phone number, if you are dealing with a legal PDL, be proactive and call them - make payment arrangements that you can afford - and keep them. If you are certain that you are dealing with an illegal PDL, then you can play hardball with them.
No insult is intended to the OP on this thread - I'm just trying to clarify what might not be clear here - Internet PDL does NOT equal Illegal PDL in all cases.

No offense taken SBH. At this point most IPDL's are running roughshot on the public however, and I am seeing people put their "actual" obligations on hold while they pay these people. They make that a priority. Also these lenders get you in the mindset of being a victim, and I do encourage all that visit this forum to stop playing the victim. Again, morally and ethically you should be trying to pay back the principle of what you owe, you do not have to take abuse, you do not have to be harrassed, and you do not have to open your life up to these businesses, and I do use the word business rather loosely. Those that are legal are few, and I do encourage everyone to check into the company licensure, and try to work with IPDL's, but don't be a doormat, and do not expect a big pile of niceties when trying to deal with them, they are not nice people, and this is not a nice business. IPDL's are hard to track and the majority *not all-but the majority are not following the laws of the states in which they do business and are hesitant to open themselves up to legal scrutiny it they choose to pursue the borrower with legal action A summary of this is, pay the principle of what you owe, keep a clear focus on what should be a priority in your life-these businesses should not be your main focus, stop playing the victim...and one more thing, don't do business with these companies ever again..hold your head up, because we are all better than this kind of treatment.
