Hi Carol--
refer to the email I sent you....in this case I would strongly recommend against agreeing to any payment arrangement. For one thing they havent even proven anything about their allegations. For another, the collector youre talking about is Midland, and they have a very bad reputation for not sticking to their word on anything. This is a common trick to try to get you to agree to a payment so they can tell the judge, "see, she agrees to pay it, so she cannot dispute it." It takes away your rights to full disclosure and validation.
Also, in your case, you have multiple FCRA violations that would add up to more than the amount they are suing you for. So, at the very least, you could offer an even swap--you wont make them pay you multiple thousands for their violations and they will close this account and mark it paid in full. At best, you can make them pay you money, and you would have more than the amount they are trying to get, so you could pay off the debt and keep the rest as a parting gift.
