i have a place called check administrations calling saying that a payday loan company I got a loan from is threatening to file charges of attempting to defraud them and something else. Can they do this and what kind of charges are these? Civil or criminal?

bourne -

it depends on whether the payday company is licensed to lend into your state or not. They would have to prove you took out the loan with no intent of ever repaying it in order to prove you defrauded them.

You cannot be arrested or go to jail for defaulting on a payday loan - regardless of whether they are operating legally or not.

Any charges would be civil, not criminal, in any case.

However, why don't you take a moment to give us the following info, and we'll do our best to help you get out of the payday lending cycle:

-state you live in
-what lenders you're dealing with
-whether they are internet or storefront
-how much you borrowed from each
-how much you have repaid each one (including fees and interest)
