I am being sued by a creditor for failure of payment. It was delivered to my home by a constable last week. I do not know what I should do as I have never been sued in my life before.
Could I please get some good advise.

Thanks

I was just served papers by a constable and I contacted the attorney regarding what I need to do as this is all new to me. Well the attorneys paralegal told me that I could make this go away by agreeing to a payment plan. Is this typical? It seems too easy.

hi BW--

people are asking you good questions here, please help us to help you as much as possible by answering them.

The company suing you--is it an original creditor or a collection agency?

Do you know when this debt first became past due? That is very important, as the debt may have passed the statute of limitations in your state. if it did, then that is your defense and it will all be done with in short order. What state do you live in?

give us a little background info and we will be more than happy to help you. in the meantime, do NOT make ANY settlement agreement with ANYONE regarding this debt. We dont even know if the company suing you has legal right to collect on this debt or not!

Jon
