Kim, are you talking about being sued if you stop making payments to your creditor(s)? From what I have seen, there are no hard and fast rules. I am less than 90 days past due with several different creditors. One of them is already threatening a lawsuit against my husband. The interesting thing is that I also have an account with that same creditor with a higher outstanding balance, and they are not yet threatening to sue me! Also, I have seen posts on this forum where others have even higher balances with that same creditor and are further delinquent, and they were never threatened with a lawsuit. So each situation is different, and it's hard to predict whether you will or won't be sued.

#3 age of the account ?
#4 how long has the account been delinquent ?
#5 What state do you live in ?
#6 do you have any assets ?
#7 do you have any equity in your home ?
