Proof of Ownership of Debt

Negative entry in your crediut report for the same debt is a very common malpractice done by the done the Debt Validation2 letter to the concerned collection agency. If they fail to answer it then you can dispute with the credit report agency for removing the same from your CR.

But usually after getting a DV this CA passes on this debt account to a different CA and that????????s why you see a different name on your CR. The only way to counter them is to send a debt validation letter. You can find a sample of DV letter here.

I appreciate you comments but I must not have made myself clear. I am asking how to force a collector to prove they have ownership of the debt. This is basic contract law. If John Smith loaned me some money and I did not pay him and then John Smith sent Scott Johnson to my house to collect on the debt I would tell Scott Johnson that I did not owe him any money and to leave and not come back. So I do business with company "A" and then company "B" puts a collection on my credit report. So I send company "B" a demand to prove they have the right to collect on this debt. I am looking for some guidance on this issue. I would never just give money to a company because they say I owe them, I will require them to prove it. If I went in front of a Judge and told him you owe me money he would say prove it. Please advise.

P.S. Already sent the DV letter and they sent everything back except proof they have ownership of the debt, now what?

That pretty much is the only way you're going to compel them to prove it, thru the discovery phase of litigation. Whether it be them suing you or vice versa.

If I were in your shoes then I would have contacted the original creditor and tried to negotiate the matter with him. Hope other members may give their views too.

Anthony....not sure if you understand what this forum is for....this is a forum dedicated to credit repair and dealing with collectors....I'm thinking that you are attempting to make a notice by publication(?) of the above....I do not beleive that posting this here would be a valid method of accomplishing this....that would require you to post in your local paper and the local paper in the city Focus Rec. is in......Maybe if you told us the details we can advise you how to accomplish your goal???
