Dear Forum,

Dear Moderator, if this is the wrong forum or pub, etc., would you be so kind as to place it in the right one for the most attention concerning this serious personal matter? Thank You.


I received a letter from my State of IL AG office today, which was very nice to have this office on my side, and I am not sure if the contents of the letter is good or bad for me.

The story is that in Nov. of 2006 (I have had my car financed with WFAF since 7/11/2003), Wells Fargo Auto Finance decided to change everyones account number for some unknown reason. It sent my account with them and the credit agencies in a tailwind. They have been reporting false and hurtful infomation to each other about my account with them for almost 2 years. I have spent almost 2 years trying to correct this in every way known to man and women but to no avail.

Now today, as I said, I get a letter from my states IL Attorneys General's Office along with a apologetic(?) letter from WFAF saying they are sorry.

But what WFAF did was remove my account from all 3 credit agencies all together. I did notice that my FICO score went up 10 points, but my thing is that all that 5 years of credit history, which was very good, never missed a payment, etc. is now GONE.

I am not sure if that is good or bad, and my question to you all is....What do you think? Should I leave it the way it is ( I have 10 days to send a letter back to my states AG and let them know if I accept what WFAF did or not), or tell them to update correctly, if they would do that. Anyone gone through this or something like this before?

Yes I do want my future payments reported, but now WFAF wipped the, as they call it, "trade line" off all 3 credit agencies. But during all of this since Nov. of 2006, nothing was reported to the 3 at all. It just contained all bad, wrong, stalled, hurtull infomaiton that they never updated with the right info.

If they report now, it will probally go nowhere. I really am confused by all this.

I can understand the confusion. Honestly, I would reject their offer and demand the past payments, as well as future payments, be reported and reported correctly! Seems idiotic that they feel they can just wipe the tradeline out and you are supposed to just live with their mistake.

I tend to agree with you. It seems in the WFAF, letter that came with my states AG letter, that they where doing me a favor by wipping it all off the board. I think I will send a letter, that the AG requested within 10 days, and state that I am gratful for the long overdue attention on WFAF part, but I pray that they show the almost 5 years of good payments without the degrogatory almost 2 years of horrible conduct on WFAF and the 3 credit agencies parts. I just do not want my AG to get tired of me and back out at the last moment then I am left alone as before while WFAF puts all the bad stuff back on my reports.

Do some research on the FCRA...if they made a mistake, they have the obligation of fixing it. Eliminating a tradeline to fix their mistake seems out of compliance with the FCRA.

I would explain to the AG that you sincerely thank him/her for their efforts, but that deleting a tradelined that was paid satisfactorily is not acceptable.

Luke, I would insist to them to up date their records to show that you have made all of your payments on time. My friend has her car loan through them and they sce$$wed her around for several months continually harassing her for payments they had already received and she has the cancelled checks to prove it, and what is really nice of them, she has been a customer of theirs for 20+ years....nice of them huh :twisted: .

OK, ladybug. I am at this moment sending the response letter to my AG that she asked for stating that I want WFAF to put my correct trade lines of 5 years of good payment history on all 3 credit agencies and also asked in a good faith that they forgive my account in full for their horrible service.

what do you think?

you got that right ladybug. Have you ever visted a site called
ripoffreport dot com? If you do go there type in their search area wells fargo auto finance and you will see thousands of stroies about them. Also, go to wellsfargosucks dot com and go to the horror stories. You will be amazed at all the horrible things they have done. let me know.

luke--the FCRA is actually not on your side on this one. The law makes no requirement that forces them to report on any credit file, it is their choice to report or not to. The only requirement in the law is that anything that they choose to report must be accurate, or if an error is found, that they take steps to remove the error. nothing in there states that they must report it, so IMO there is no FCRA violation like this.

However, I would still contact them and request that they report your actual payment history to the three bureaus--the worst they can do is refuse. Being that they just put you through all of this mess, it seems like you have them backed into a corner of sorts, I would try to use that as leverage to get the accurate reports made.

I did not know that but it does make sense. I sent a letter off today in response to my staes AG concerning just that. I asked WFAF to entry 5 years of good credit history in which I earned on all 3 credit reports and to also forgive the balance of my car payments which is due to be paid off this year for all the horrible service, 2 years of "credit demeaning" history on my reports, aggravation, etc. It does not hurt to ask.
