Your hubby can request validation also, but you do not indicate if there is a suit currently on his -- which is important because it could be a 'rent-a-lawyer' bent on merely scaring you.

Bear in mind Discover has a reputation of very good record keeping which could be used to get a judgment in court. I would contact Discover directly to start settlement proceedings. They will have any documents you need.

I spoke with a lawyer today and he said that all they have to come up with for debt validation is as little as a piece of paper with our name, account number and balance owed on it. How can that be? He said it would hold up in court...period.
I have seriously researched myself into a brain fog and complete confusion. I see a lot of you writing your own debt validations...is this what we should do first. I don't have the $1000 I need to retain a lawyer and I don't want them to win a default judgement and then have to constantly be worried about having our accounts levied.
I would really like to try to settle...should I bother doing a debt validation or just contact Discover and see if they will accept a settlement or at the very least a repayment plan?

My best advice is to call Discover and see about working with them. The lawyer can request his proof for suit directly from them.They may be hard to deal with,but this can hopefully avoid a court date.
discover card problems
I was just on the phone with a law office that has my Discover card account and they wont budge! She said they are hard to work with and that they have filed judgement on me. I was just contacted 2 wks ago about a payment arrangement , but this wont stop the judgement. my settlement options are not that good either. on a balance of 8300.00 now it has went up with court fees and such they only would take 6500. and that has to be paid all at once. So I made payment arrangement to start and if i dont go to court then the judgement will be there till this is paid off.

I have got a settlement for half of what we owe. I have till monday to file a response of the suit they filed. I am not sure what is better to just pay the darn debt or go to court and see if they can come up with the proof of debt. If we go to court will the settlement we have already been faxed by discover still apply in court if they can prove the debt. From what everyone else is posting here it seems good that we got the fifty percent but they still tacked on over two grand which makes us paying more than the 50 but I really was hoping for alot less but time is really a factor I think. Any suggestions would be greatly appriciated.
