Hello,
i have two pdl's at two small store front
a-z cash for 1,000...they own 3 stores in three diff. Cities in texas. I took out the loan about 5 months ago, then our water pump went out on our truck which ended up costing us 250.00 to replace, i was unable to pay the rollover for that month so i stopped my debit card, so they could not debit the 200.00 out they needed for that month. I've defaulted in paying anything, so this very month 2 months later i receive a letter...very cheesy letter (made off of a computer) stating the acct #, my name and the amount showing i owed 1,200.00. Also stating to me that they would seek legal action with the d.a. if i did not respond and try to work matters out with them over this loan. I called and explained my situation. The man (william, store mgr.) Stated he would have to have at least half the money then they could work out payment arraingements. Well crap now i dont know where i stand?? Are they going to prosecute me?? At the end of this letter it also states "this is an attempt to collect a debt, and is used soley for this purpose" something to that effect. I dont have half the money they want, so now dont know what to do, but to sit on it and sweat or go on with my life and see what becomes.
I have another payday loan that i have paid some on at another store front called swift...they are small with only 3 stores. I have not heard a word from them, and owe them 700.00, stopped paying them after the situation above. Closed out my checking acct. And started a new. I'm really not sure what to do. I live in texas and i have been trying to find out our laws are, but to no avail have i found anything. Not even sure if the d.a. will speak to me over a situation like this, and if it was to go that far, if they would even work with me on payments. D.a. is diff. From the attorney generals office. Any suggestions please???

hello,it sounds like these are not CSO'S because debts are civil
matters not criminal ones.sending a note saying the DA would
get involved in any way is illegal.someone should be able to
clarify that,but it looks like these are still mom-n-pop pdl's.

THANKS FOR THE RESPONSE PAUL.....YEAH THEY ARE SMALL..THE FIRST ONE I TALK ABOUT A-Z CASH, WELL I WAS TOLD THERE OWNED BY TWO DOCTORS OUT OF WACO, TEXAS...I LOOKED THE CO. UP ON THE INTERNET AND IT SHOWED ONLY THREE STORE FRONTS...WACO, CORSICANA AND THEN THE TOWN I LIVE IN GUN BARREL CITY, TEXAS. SAME GOES FOR THE OTHER CO. SWIFT CASH...THEY HAVE POSSIBLY FIVE. I HAVE HEARD NOTHING OUT OF SWIFT AND ITS BEEN LIKE THREE MONTHS NOW.

I think they are just trying to scare you with the DA bit. I beleive in Texas you cannot be prosecuted for a bad check on "payday" type loans, but as far as CSO's go I'm not sure. I think it could be argued that they are the same thing.
You will need to try and set up payment arrangements with these places. They are legal, and can take steps to collect on the debts, so that means they could sue you to collect. The best thing to do when dealing with a storefront is keep up communication with them. Don't ignore them or run from it.

But - Next time they call, tell them that the AG doesn't arrest people - They are there to protect the people. If anything, the DA would be the one to file an arrest warrent.
They cannot have you arrested unless they can prove that you commited fraud. If you didn't, then you are in the clear. Imagine how full the jails would be if everyone that couldn't pay their bills got arrested!
