I received notification by local municipal court that CashLand is suing me for balance due. I defaulted and have paid half of what's owed ($380 pd), but ran into difficulty repaying when my husband was laid off. I'm not sure what to do. I really do not want this to go forward. Any suggestions; advice?


Wow, sorry to hear this, when I defaulted with CashLand last year they sent me to a collection agency. If they have the courts involved then there is a chance you can not do nothing. One other idea I can think of is go to your court house and make a payment in an escrow account. I believe you can ask for a continuance and that may buy you some time. Maybe you can put half in a escrow and have the other half when the court date comes up. I'm just thinking out loud and do not know for sure, but it maybe something you can ask the court house.

first and foremost make sure you file an answer with the court so that you dont end up with a default judgement. second contact them and see what you can do to negotiate payment. then do as the previous poster suggested and sock as much money as you can between now and the court date (if you go that far) that way at the very least you can come to court and state that on that day you can pay x amount and the balance by y date. depending on the court, you may have an option for mediation.... if so, use it adn try and avoid the judgement

I'm curious to know when you defaulted on your Cashland pdl and how long you paid on it before they served you with court papers?

I too am in Ohio and at the end of this month I am going to have no other choice but to default. Things have gotten so far out of hand myself. I don't know where to start.

I called the Ohio coalition of responsible lending and they pretty much said that the pdl companies can do whatever they want. I think the new law that has been signed should have had a little more revision to it as far as collection procedures etc.

Does anyone have a copy of a Cashland Truth-In Lending Statement? There was one provided in the summons, but it doesn't look like anything I have ever signed and all I remember receiving is a ticket receipt every time I took out a loan. I just want to compare information.

I may be having trouble with Cashland in the future too. They won't accept the payments T & C are making them and they left me a message today saying they were going after my wages. T & C said if it's an assessment, my employer can refuse it. If it's from the court, they would honor it. I faxed and mailed a cease and desist letter to them and another one this morning. Can they still take me to court even though I'm working with a debt consolidation company?

I don't know if this info will help you, but Cashland is a member of The Community Financial Service Association of America (CFSA for short) and they must abide by their rules. The website is cfsa.net if you want to know about it. Also you said that they refused your minimal payments, I know for a fact that they have to give you an Extended Payment Plan (EPP) for short that allows you to pay back your loan in four equal payments that are due on each of your next 4 pay periods. Of course if you were trying to do less than that then this info wouldn't have helped you at all. Also, since Cashland is legal and licensed they will come after you for their money if you don't pay them. I would try to talk to them again to see if you could work out something outside of court. The moderator is the moderator because he definitely gives sound advice. I was seriously in debt (and a year at law school did not greatly help but did not hurt) and was starting to be sued. Do exactly as the moderator said-Answer that complaint. It is not hard. You can use exactly the same format as the complaint, since they will obviously research and do what is required by your court of jurisdiction.

File for discovery-demand the paperwork (often lost and they will in turn file to get a summary judgement and you need to stick to your guns).

However, without legal advice and it may be prohibitive, it is hard to win if you are in the wrong. However, I defaulted on a Cashland (and I was in the cycle and paid many many early or on time) loan and they made arrangements with me. I made the ifrst payment as agreed-then told them I was paying at a certain rate until paid. They said it was too long and I said it would be paid off long before they could get a judgement then the garnishment shich in turn tkaes time.

Please Please people stay away from Cash Land or any other lending place. Once they have you in their grips there is no way to get out of it. They tell you to borrow responsibly so they give you an amount your elligable for even though when you have to pay it back it is your whole check. When you are trying to get out from underneath these money sharks and try to make payment arrangment so you don't have to get back into that situation again it is their way or no way!! They had me on the phone crying and they could of cared less what the situation was. They told me to go sell a TV or to get out and go to work ! I have even had them tell me to go to other lenders and get the money so your right back to square one!! They have you one way or another. Even if you do go into the office and pay what you can it does not matter if you have a 1,000.00 loan and you have paid 400.00 you can be sure if you have direct deposit they will still ach your accout for the whole 1,000.00. These places are putting people in terrible positions and no way out. It is a never ending circle that we have been caught up in for a couple years. My husbands housr had been cut at work and he was not bringing home enough to pay the loan off..... I just wanted to make things right and pay this in full . I asked to break it down into 4 payments but NOOO only three would do!! PAY DAY LOANS HAVE RUINED OUR LIVES!!!!!!THEY SHOULD ALL BE CLOSED DOWN!!!!!!!!!!!!!

Guest from Ohio, you are not alone we have all been there. I sincerely hope that things turn around for you and you can get back on track. Payday loans have trapped more people than we can probably count. I would close the account they are debiting. Debt is a civil matter not criminal so if they pursue action against you the court system will set up a payment plan that Cashland will have to accept. I wish you the best of luck and please keep us posted on your situation.

I just got a call from there . I had to default due to emergency surgery last year.  Was depending on taxes to come in last feb. (did not get them till June) they were going to offer me 25.00 payments but then jumped it to 60.00  with a 9.99 fee.  This place is crazy. They wanted to know when this year taxes will be in and I told them nicely I have yet to get my w2 in the mail.  Urg thank you all for the other postings. Glad to know others are in the same boat:(  good luck to you all ..
