Payday Loan company emails and calls every day

I've looked for an answer to my questions but cannot find one. I am hoping someone can help. or point me in the right direction
I TOOK OUT A PAYDAY LOAN (IMPACT CASH) stupid me... anyway, I missed a payment. I got a few phone calls and when I returned them, the ext went to a busy signal, finally after the 3rd try, I pushed 0 and got a girl named Nicole.she said that ext was on a rotary dial... I told her who I was and she explained I missed a payment and an setp up a payment plan. I also asked why the payoff was suddenly 490 when the loan was 300. She stated they added fees. Anyway, I set up to call her with a cc payment for the 25th, as that would be my next paydate. She sent me a confirmation email with her ext and said to call Fri.
Since then I have received (since the 17th) 10 different agents calling me, 8 emails and 6 text messages. I have responded to all the emails stating I have set up terms with nicole and one returned my email saying they had a new system and it was acting queer!! I have talked to most of the callers, they say the system will keep calling till I pay, now the newest message is I have not returned any of the agents calls, so I am going to collections if I do not respond in 24 hours. I have kept the phone records , a couple of the voice mails as well as the emails... where do I turn next.. HELP!!

First of all what state are you in? We need to look at your pdl laws for your state. Is this pdl a storefront or an internet pdl? Be very careful on giving any of your financial information out over the phone like this as it is giving them free rein on your account to bleed it dry.
In order for those phone calls to stop you need to send them a cease and desist letter which you will find if you do a search in the search box for it and a letter revoking any voluntary wage assignments that maybe in the small print of your contract. Save a copy of this letter to show to your human resources department if they threaten wage garnishment. Tell them to only communicate with you via USPS or email so that you have a papertrail.
It sounds like they are trying to strong arm you into paying them super fast and being unreasonable in doing so. Do not speak to them on any terms other than by USPS or email. How much have you borrowed in principal and paid back if any?
By providing the answers to these questions we will be better able to help you. Hang in there someone will be along to post your laws and advise you further.

I agree, please be careful giving your personal info to any of the PDLs. The C and D letter will cover just about all the concerns you may have regarding your loan/situation. I can tell you though, that even if you have made arrangements to pay by a certain date, you will probably get phone calls anyway. Either the "computer" doesn't have the info and/or the next person to get the list your name is on doesn't have the info either. They will call until you make them stop. Please keep us posted.

I live in Florida. The original loan was for 300.00, they say another 90.00 is interest fees. now they upped it to 490.00 that I owe.
They are an internet PDL.. fill out form online, matches you to a pdl, then they call you..send monies.
I have paid them 90.00 so far. Then when they went to take the next payment out, the bank declined due to insuff. funds.. (my fault due to job change and no direct deposit yet) They also tried to take the money out twice...
In Florida , I was told wage garnishment is illegal without a court order.
Would this also , by terms of the Fair Debt Collection, be a form of harrassment and I should next contact my lawyer?

Thanks for the info. Someone will be along to post your State Laws and interpret them for you. In the meantime, I can tell you that $90 on a $300 loan is pretty typical so you can account for that. Since they tried to get your money twice, I am thinking that they have hit you with NFS on their end and that is where the additional "fees" have come from. You need to read the sticky about closing your account and if it is at all possible, I would suggest you do so. That is the only way they will stop the debits to your account. I do have a concern with the fact that they now have both your bank account info and your credit card info. That might be something yo want to look at. I am not sure who Impact Cash is affiliated with but for some reason I think that it may be offshore, and illegal? Someone on here can verify that info for you, I am sure. The good thing is you have only paid them $90 on that $300 loan. If it is illegal, you would only need to repay what they deposited into your account, minus any fees they have already deducted. You will need to get a C and D letter to them to stop their nonsense. You can find it in the do it yourself section. And don't beat yourself up over this. We have all been in your place. Lots of times we do the wrong thing for the right reason. Hang tight. Others will be along to help as well.

And when they say you haven't returned any of their calls, say something like "obviously you haven't been reading any of the notes made on my case" and make them read them out loud to you. Turn it back on them and show them for the liars that they are.

I haven't given them my cc number, yet, they only have the bank acct. And actually I was going to use on of those prepay debit cards to pay them, then close the card after the monies are taken, and repeat if necc. I will send the cease and desist letter today. I started to beat myself up over this because I felt I did something wrong.. but after reading the posts and talking to some people who I find out hav been down this path, I realize there are more important items in life than these scum.. IMPACT CASH HELP
Well the calls haven't stopped as well as the text messages and emails. I have responded to each email and phone call and kept transcripts. Everytime I talk to an agent they say, there is nothing in the computer stating I talked to another agent or made arrangements. I now receive a call and email from there collections department, stating I now owe $580.00 , and since I have not responded to their calls, etc,.etc. So, that ticked me off... I sent off a letter, stating that their statement was untrue, listed whom and when I talked to them and stating I had all good intentions of contacting the original agent I spoke with and making my payment, but since I have now gone into collections I sent a letter describing what I have learned from the good people on this site...they are illegal in Florida, there collection is null and void, however I do feel in good consiousness, I should repay, as per Florida law, the original amount loaned, and will do that in 3 monthly installments and they need to send me by USPS mail, a copy of my terms and an address where to send the money order, also once again informing them that I revoke all ACH transfers and have contacted my bank and filed a report as to unauthorized ACH transfers, also revoking any wage garnishments. I also atttached a copy of Florida PDL statutes and laws for their future reference. Since then (11:30am EST Friday July 25) , I have received 3 phone calls (no message left) 2 texts, and 2 delinquent account emails, all (but the phone calls) state "Your account with Impact Cash remains delinquent. We have previously notified you of this situation, with no positive results "
Any ideas where to go next. I do have a lawyer on retainer?? .. I can post the letter I sent and emailed if that will help to make sure all the bases were covered... Thanks for any continued help and insight

Have they supplied you with an address in which to send the payments? No address, no payments, that is basically what I would repeat to them. All they can do now is threaten you, just don't give them anyone to talk down to, eventually they will either accept your terms, or not be paid.

As you see, the payment if it was to be ACH was not to come out till Fri the 25th. They tried to remove it on the 24th. They have a letter stating I revoke all ACH . You can also see the amounts differ, one is pay what you owe 300.00, another says you owe 190.00, etc.etc. it says to mail a money order to the address below... I don't see one! And if I dispute the debt. etc.
So, here is my question.. Do I resubmit the C&D with state laws and all that again, (now I have a fax number) and do I ask that they only contact me by USPS and send me paperwork to validate the debt. This reply they send, doesn't comply with what I originally sent them>!
Payday Loan help with Zip19
I have a similiar problem to yours vk and Zip19 keeps calling and is threatening to call my payroll department. I have tried to call them back to set up payment arrangements but have gotten nowhere. Can any of you offer some help?
I live in Texas and Zip19 is an internet based PDL. My original loan was for $600 and the payback was $719.98.

They state they tried to remove the monies on July24, well according to the dates of original withdrawls that was sent, they weren't supposed to withdraw money till the 25th.
Now they send me a letter stating I still have nor responded to any of their requests and call to make arrangements, etc. I started to write them a response that their email to me was falsely stated, and that I have responded, but it seems no one updates their computers, but I do have transripts as well as they tried to perform an ACH after I sent a letter revoking it, and also tried to access my account on a date that was not in the original statement... guess I go to the AG now.... however, the phone calls and text messages have stopped. but they still say to send money to address listed below.. which is still not listed on the reply ! thoughts? anyone?? I hope this makes sense..

Essentially, you should have to payback the $300 original loan. It sounds like you made one payment on your account. Most likely, the total is $390 with any "interest" and the amount they loaned you. From their first response, it sounds like they just want the $300 now. I know this mail address will work for you to send a money order if you wish.

Same situation
I too, took out a loan with Impact, however, I've paid them the $390.00 back. II was changing jobs, and would have a different direct deposit, and told them not to make a withdrawal that week. They did anyway, and overdrew my account. So now I'm trying to have them stop harrassing me, especially since I want to make my payments via Money Order. There is no address for them. Any advice?

I tell them I will only discuss this by email or USPS, they still call and tell me they will keep calling and texting till I pay. I sent cease and desist, they still tried to access the account. I have my bank going after them, I have contacted the FTC and the Florida AG, and am now writing the Utah AG and BBB. I also sent copies of the Florida loan law, found on this sight as well as revoking ACH and wages. Again, I am willing to pay the amount due, but only by money order, and they won't send me what I am asking... whee to go next?
Impact cash is a scam
I applied for a Payday loan online with Impact Cash USA under the pretences of a short term payday loan :oops: . Contract that was sent called the 'loan' a rebate. It was a 'rebate' for $300.00 and $200.00 worth of 'online phone cards'. The contract states that you will pay for the 'rebate' for at least 22 weeks. I called to dispute and cancel the contract and there was a $434.00 cancellation fee and if you did not cancel it within a certain time they would still charge you and continue to debit your account. Whatever you do, if you absolutely have to get a pya day loan read the print and when they call to confirm the 'loan', make sure ask many questions and read the fine print. :wink: I am in need of assistance to have them stop sending me emails, calls and texts. After requesting to cancel they have now sent me email notifications of the '200 online phone cards' whatever that is. When i go to the link it gives no information. I am so fed up with this company. I would have been better off borrowing money from a loan shark that threatens with breaking limbs. At least they are upfront. :(

impact ripoff
they took over 900 out of my account saying i didn't ask for a payoff. well the other two loans i got were 390. and they called me. i was supposed to get a 50 dollar visa card for taking out the loan. anyway they still want me to pay 165 for them to stop trying to take out of my bank account. they try every day three times a day when i told them i have no money i will call with a prepaid card. they ruined my account and credit. i am worse off now than i ever was. this is unlawful and unjust. nobody should pay 3000 for a 300 loan.

I, too am being victimized by these thieves! My original loan was for $300, they debited my account 3 times for their "fees". By the next due date, I was over my head (for other reasons) in debt and upside-down in my mortgage, so I am filing Bankruptcy. Can these crooks be added? Haven't asked my attorney, yet. There was a temporary decline, then right back to where it was prior to reform. Contrary to what many believe, we do not get that many BK's. I probably see 10-15 per year out of my 3 stores. Lately, we have seen a big increase with credit counseling.

Is Impact Cash a licensed PDL in the State of Oregon? And if it would be more helpful. What is the website I can check for a few other PDL's to see if they are legal in my State.
