I had been referred to MRS associates by a credit card company, I have been working my way out of debt for two years now. The phone calls began probably in July. I made a payment arrangement but wasn't able to live up to it do to a lose of 2nd income. I had tried to work something out but they never allowed me to pay on schedule that would benefit me. It was always on terms I could not meet. The final straw for me was waking up to an MRS employee, rudely telling me that she was refering me to the state of nm. Then to make a long story short, became quite anger with me started raising her voice at me and proceeded to call me a debtor and liar. Telling me that I was always lying and that she didn't really believe my story of loss of 2nd income, because I was nothing but a liar.
The call ended with her supervisor breaking in on the conversation ( I guess he had been monitoring the call) and once again when I told him when I could actually pay them, which it was 2 weeks later than what he wanted. He told me that was inadequate, and I needed to come up with the money by Monday, granted he's calling me on Saturday, If I did not have the money they would proceed with futher action and hung up on me. So now that they have completely upset me on my day off. I waited until Monday to call the credit card company directly and let them know what happened. I also let them know that I absolutely refused to pay MRS Associates one red cent of my money. I will pay them directly, but there is no way I was having MRS Associates collect money from me to pay them. At first, they told me that I would have to pay MRS, since that's the company they contracted out to collect on my account. I was a little discouraged, but asked to speak to a manager or someone of authority that I could explain my situation to. After a couple of minutes a supervisor came on, I told her my story, and let her know that she could either let me make payments to them directly and get the account paid off in 2 months or leave it to MRS Associates to collect and since I had no intentions of paying MRS Associates anything because of the way I was treated, there would be no telling when they would get the account paid off. She put me in touch with the proper channels and eventhough MRS was offering a settlement agreement and paying the credit card company directly means I won't be entitled to that agreement. I don't care I would rather pay the balance in full then take a settlement and have to deal with them. The credit card company agreed to me paying them directly, and I sent out 1 of my 3 partial payments out that day. It's been a whole lot easier working directly with the company than having to put up with the likes of MRS Associates.

Welcome to the forums.

Creditors can collect money from you only if the account is not sold to external collection agency. If they are receiving money from you, the collection agency will still try to contact you in recovering the money. Check with your creditors if they have sold the account or not.

If the creditors have sold the account and are taking payments from you, please request them to issue a certificate so that you can produce it on legal grounds later.

Also, check your latest credit report and see the latest status of the said account. If it is in collections, then you will have to take necessary steps accordingly. This is to ensure that the right company receives money towards your debt account and update to the bureaus after payments are complete.

Get everything in writing from the agency that you are dealing with so that you don't have to face problems at the later stage. The ultimate result of your payments made should be shown in your credit report and the agency responsible to collect money can only do so. So, if the collection agency is not involved in the process in anyway, they should not make collection calls to you.

Please let me know if you have any problems in this matter. I will make things clearer.

Hello to all u free people.... All I have to say about your complaining about collectors is get a
new job. You keep us in biz!! You say we have no
heart. Well u kinda well yea u steal from companys
but yet we are the rude ones. HA HA.. I get paid
because u cant pay for things. So what I call u a
couple times a day. U owe my client 4,000 yet I
am the rude one. Would you not call a person to
get the $$ they owe you. Get your fdcpa straight
and learn how to borrow $ before you call us heart
less cause no affence but I have a job cause you
cant pay your bills to someone u owe !! Thanks

Imacollecter, real tough guy behind the computer you are. Typical, I bet you are real tough on the phone also. With all that so called money you make why don't you get an education because from your post it seems like you have a sixth grade education, but that might be an insult to all sixth graders.

I tried to do that (pay WA Mutual Credit Card Co) instead of the rude idiots at Phillips & Cohen (P/C) collection agency and was told that they couldn't help me and I would have to deal with P/C! When I told them that I had tried to pay P/C and they didn't take the payments out of my account it was like, 'oh well...sucks to be you". So, we never paid P/C. Now MRS is calling us. Oh joy and rapture. However, I now know to send a validation letter!
