Summons and complaint were left on my front door with my maiden name listed as defendant. Cambece Law Office are the lawyers listed - should I call them, file answer or both? Nothing suspicious on my credit report but I put fraud alert on just in case. It said I have 20 days to answer


No this is not my debt. I hired a lawyer who filed appearance and answer, motion to dismiss. Cambece contacted her and the person they are looking for has different social security numbern and date of birth. They want a copy of my driver's license to prove it isn't me. I'm not comfortable giving them my driver's license - doesn't have my ss# anyway. Anyone have any advice on whether I should give my lawyer a copy of the license to provide to them? Thanks in advance for any help.!

COnsult with your attorney about it, but you will have to provide something "official" that shows your actual name. Perhaps they would be happy with viewing a copy of, say, your marriage license, or something else? Your attorney can best help you sort through this. You may also consider contacting the bar association in your state--I assume that Cambece has an office in your state since they were practicing law there enough to sue you. This is what I consider a frivolous lawsuit, and lawyers have at their disposal investigators for just these kinds of things--like identifying the right person to sue. A simple comparison of your name and SSN is something that they could have gotten so easily it isnt funny with the resources they have available, and because they neglected to use those resources, they filed a lawsuit against the wrong person. Thats like if you owned a gray chevette, but at the mall parking lot, you got into a red corvette "by mistake" because you "thought" it was your car. Frivilous lawsuits are heavily frowned upon by bar associations--I would consider filing a complaint on this one there.

If they received a letter from your attorney they know you have representation. If you are represented you should leave all communication up to him. Also if Cambece is really a law firm they should know that they are not allowed to contact you directly unless they are the firm of Dumb and Dumber. That is a 1000.00 violation plus your lawyers fees plus forfeiture of debt. I can't believe what I am reading here. If they have any sense at all they will agree to walk away from this.

Cambece contacted OP's Lawyer.

I would think that the attorney could produce an Affadavit proving the ID of the OP as being different than the consumer Cambece is looking for with no need for OP's involvement any further. Let your Attorney handle it from here.
