I looked at the website and they list no physical address. They list on the site they report to the credit reporting agencies.
I live in Washington and Paycheck Today is not listed as a legal company. What should I do?

i would file complaints with your AG,BBB,and the FTC.you are
correct they are not licensed period.i also would send them a
limited cease and desist letter informing them not to phone you
at work.send it certified mail return receipt.they can't and won't
take you to court,or have you put in jail.debts are civil matters
not criminal ones.

Under those circumstances I would suggest that mjj send any communication to the admin contact at armfl at the above address, as well as the one for PayCheckToday. This actually is pretty scary. I have said before that with all the heat these guys are getting I am afraid that they wlll take on a "different" identity to get this money one way or another. I guess their philosophy is if they can't get you one way, they will try to get you another. They are like a bad virus that keeps mutating to destroy lives.

The next time you speak with this CA over the phone, tell them by Federal law they MUST now send you a dunning letter within 5 days after the initial contact or they are in violation of the fdcpa, in which you may file a counter suit, and sue them for up to $1000.00, plus Attorney fees. :)

You can file a suit against ARM for violation of the fdcpa for saying you can go to jail and for refusing to send a dunning letter upon request. One in one thousand people actually follow up with a suit and the CAs know this. When they do get sued it is cheaper to settle out of court. They consider it the cost of doing business, There are attorneys that will handle these cases on a contingency basis with no out of pocket cost to you! The debt and the collector will disappear the moment they know you are represented.

On another note I am also dealing with PayDay Loan Yes and I called them from my work acting as another employee and told them I didn't work there anymore and they need to cease calling. They did this even after I told them to stop. THey were very polite and apologetic and removed my work number!

I reported them to the banking commision in CT because they weren't licensed to collect and they took over for me...I haven't heard from them since (knock on wood) hopefully they are gone for a while...

In washington state, internet pdl's must be licensed. if they are not (Paycheck today is not) Washington State Law explicitly states that the loans are unenforceable and uncollectable. Period. Further, ARM Florida is not licensed in washington state to collect. they can't touch you. also, there is no way you could go to jail. I would file a compliant with the washington state department of financial institutions ( www.dfi.wa.gov) Since the clowns at arm threatened jail, they not only violated fdcpa but washington state law as well. you can file a complaint against them with the washington state department of licensing. Any questions, just ask.

Score one for the little guy! I haven't sent the letter by registered mail yet. Should I still do that?

Congrats! I really do think that sometimes the "head honcho" really doesn't know what is truly going on. That is how I got my PIF from Star Advance. I went right to the Admin and she gave me my PIF, and apologized for "her" company putting me through all the nonsense. So I guess you can call this a "done deal"! Glad I could help the cause.

I just got a call from ARM on behalf of paychecktoday. After I explained to the agent they were trying to collect on a debt that indiana does not recognize, I was bumped up to a supervisor.
First, I said I would appreciate if we kept this call civil and to the point-which, they at least did that.
I went over the Indiana statute and explained that, in fact, we had overpaid. I also asked if they had mailed a dunning letter and they claim to have mailed it yesterday. I advised them I would be responding to that with a DV letter as well as forwarding their letter to the Ind Financial Instittions office.
The supervisor just kept referring to the contract and I kept saying since PCT isn't licensed, under Ind law the contract is null and void. She must have realized we were at a stalemate and said feel free to forward my issues with the Ind AG but the debt was still going to be collected on.
How am I doing so far and what else should I do next?

I sent them a request for debt validation and in that letter toward the end, I put a clause about my state statute and that I overpaid, etc. I faxed and sent them a copy certified mail. I cc'd the state attorney general and made sure I sent them a copy too. They called three more times, my cell, I printed off my bill, highlighted their calls, faxed that with a letter stating that I was forwarding this information to the KY AG, FTC and BBB. I also filed a complaint with the BBB which they answered a bunch of garbage but, I have never heard from them again. Whatever you do, be sure to start and keep the paper trail so all evidence is on your side in case you decide to go to court. The address I used is the one posted...9000 Regency Square. It is a good address, received that in a letter written by darlene graham herself.

Okay so my experience was the same but once I sent an email and a certified letter to the head of ARM Darlene, the next day she responded to my email saying the account is paid in full. I then requested a paid in full letter and she said fine. Three days later I recieved my letter in the mail with her signature. I also sent along my complaint numbers to the BBB, AG's office and the FTC. I had this done in a matter of a week!

And when it comes to payday loans over the internet, it does not matter if they are licensed in your state, it is done over the internet, and those contracts that you "read" and sign are valid.... How terrible that you make a chat forum on scamming them and then trying to scam the people they pay to collect their money back... I bet you have different forums for each agency that calls about the many other loans you have taken out and not paid back, OMG like you think you are so cool.... You all are losers who need to learn how to pay your bills and quit stealing money from honest businesses...The reason their fees are so high is because they are willing to loan your sorry a$$ money becasue if you are going to them that means you have already done that with the banks and family and friends...So it is to protect them, less people will pay them back and they know that...That is why the 3rd party collectors are so rude, they know they are dealing with credit criminals-----So keep thinking you are getting away with, it will catch up to you....You can count on that....

The messages left from Emerald Marketing just say to have me or my attorney contact their office immediately or papers will be filed in Orange Co. FL. Can they do this?
