I had paid insurance on a credit card about 8-9 years ago and it was suppose to insure payment of my debt should something happen. Unfortunately, I lost my job and my union went on strike leaving me jobless for more than a year. I did all the right things in writing letters because the credit card company did not fulfill their end of the bargain. Now, 8 years later that dead had washed out from my credit but unfortunately Robert Serian Law Offices started collecting on that debt. I requested proper letters from them and instead received unrelentless messages from one of their associates. He called himself Mr. Marcus. He was never polite and was never professional about his phone calls. Shortly there was a visit made to my old apartment stating there was a warrant for my arrest. The current tenant was peeved because they made her prove she wasn't me. I went to the police concerned about such a warrant. There was no record of any warrants against me. When "Mr. Marcus" called me back 3 days later and asked me how I liked my friends I put two and two together. My visitors (who visited an old address) were dressed in police man outfits. This scared me... especially that I was getting 10-15 phone calls in one hour. I had my husband call the number back and that's how we found out it was Robert Serian Law Offices. "Mr. Marcus" refused to speak to my husband and after that I went 3 months without any phone calls. About 2 months ago the calls started again, this time from a blocked number. He's been threatening now to put a judgement on me and when I spoke to Mr. Marcus he threatened me with another visit. I went to the police and they said they can only take a complaint down and adviced me on who to call. They can only make it a formal complaint if at least I would get a phone number for them....

It scares me that people like that can scare others this way. I am going to channel 7 news about this.... Is anyone else with me?


You need to invest in a tape recorder and record your dialogue with him. Check your state laws to make sure you are a 1 party state and you can do this without notifying him you are recording. If you live in a 2 party state then you will have to notifiy him that he is being taped. Just notify him as soon as you pick up and state that if he does not want to be taped then he will need to contact you via mail only.

The next thing you need to do is send him a DV with a full CD attached if you haven't already done so.

Make sure you document everything. It sounds like he is operating illegaly so build up a decent case against him and then sue.

also, I would give them my address, get a video camera and invite them over... proof of their impersonation of a police office, when they get there, call 911, if they leave, video the license number... not only are they violating the fdcpa, what they are doing is a crime, possibly even a felony.

Personally I would be filing complaints now with your state AG's office, the FTC and hiring a good attorney. Akong based on the harassment of at your old apartment you have good grounds for a civil suit against them. Felony on top would be just as good. The new tenent also has a case against them for harrasment.

Get the old tenent to write everything down in writing and find an attorney!!

What state are you in? With 8 years and more being past, the SOL is probably over and you can tell the attorney to FOAD!!!

I am receiving the same phone calls from a mr harris.?? they call and harrass me the same way.?? i work for collections myself and i know it is against the law to harrass someone like they do.??
