They bought the Debt from NCO .. I sent them a request for
Validation. Oliphant sent me back a copy of my last statement with the creditor. Which is not Validation .
Well today I get a letter from Hull And Associates a law firm in Houston.They are attempting to collect the debt for Oliphant
who are a debt junk buyer ... Please need advice ...

i would send the same DV and C&D letters to this person.who
knows,it could be just a collection clown playing lawyer.if not
they still are collecting and have to follow the fdcpa just like
every collector.

Do you recognize the debt? A copy of a statement would constitute validation per fdcpa. You can always ask for more but they are not required to send anything else short of Discovery. Make sure in your follow up DV to request validation per the FDCPA and Chapter 392 or the TX Finance Code. See the link in my signature. Both James Hull and Oliphant have posted the required bond with the TX SOS. Interesting info on Bud Hibbs:

No it was a personal siganture loan only it was over the phone they called me at the time to offer the loan ..through citi bank it was called a lockbox loan .. so are they trying to deceive ?? The statement they sent me from Citibank says
personal loan on the statement... That was their proof I Owned the debt according to them ...

The statment from Oliphant looks real since they bought they
printed up one of their own for me .. They also sent a copy of a statement from Ciitbank ... I last paid on it 06/07
on my Ca it shows on two of the agency as Installment
and on one as a unsecured loan ...I had signed up with
American Debt at the time all they took was my money
so on the Ca is does not show who bought it just that is was sold ..I do not know what Oc means sorry .

OC stands for original creditor.it does sound like a phony statement.

Thanks now I know what that means.
There is not a lot out there on Oliphant.. So I don't know if anyone else has ever dealt with them .. I re looked at what they sent and you are right it does look Phony.. If it is phony is that in my favor? I know I will request to see the original
paperwork the figure they come up is out in left field somewhere even with the added interest they have tacked on.
it ls almost more than the original loan amount and I did pay on for over 2 years and it the loan was for 5 years ...

Oliphant is a debt buying company, and their name is from the owners mothers maiden name. They do abide by fdcpa and do buy debt that is still in statutes, and they also have attorneys in all 50 states. They di outsource some of the debt they purchase to other contingency agencies to collect on their behalf. They are a great company and will work with you in deed if you owe a debt.

Oliphant does not buy junk debt. They do follow all fdcpa and fcra guidelines and laws. If you receive a statement from them and it has the name of original creditor on the top section it is a copy of your statements provided by the prior lender. Validation is required if you request, and according to the laws they only have to provide the name of creditor, the amount owed, and who purchased the debt.

Bull.

They'll have to prove authority to collect, debtor identity, and amount. In the mail or in the courtroom. Same thing, either way.

If you pay anyone collecting a debt in this manner, you have no evidence they really have anything to do with the debt, or any reason to believe that if you pay them, the debt will be absolved. The original creditor can still contact you later, and even if you have proof that you paid this other company the original creditor can say that that company has nothing to do with them, and you still owe them.

Why even play games with them.
Shut down to start the SOL time clock.
Any communications seem to fuel the fire.
More importantly push out your Date of Freedom.
The reason why they are contacting you is about the debt that you may or not owe; that they are trying to set claim to. Which they may be with in their legal rights or trying to swindle from you.

Forgive me for my ignorance for I not have any idea.

Why not let them serve you..
Go to court and hash it out there.

No validation? No payment. No way! No kidding!!

Lets go Oliphant financial.

I would love to counter sue you pigs.

I found out through my credit report that I have a court judgment initiated by Oliphant. I contacted Oliphant and asked who the original creditor was as I did not know of any past due or outstanding debts, they told me it was Wells Fargo. I called Wells Fargo and they told me they have no record of any type of loan or outstanding debt in my name.

I called back Oliphant and asked them for some type of documentation and that was the alst I heard from them....until I went to refinance my house and found that the judgment was still on my credit report (I kinda figured that maybe Oliphant had realized their mistake and removed it) So I called them again and asked them to assist me with the matter.

Having the judgment was hindering me from my refi and so I was willing to settle with them even though I believe the account to be fraud (I figured this would be quicker than going to court). I offered them $2500.00 to settle and have the judgment removed (the refi would save me $50k over the term of the loan) and they declined. They said they wanted 9k even though the original debt was supposedly $4500.00. I waited a couple of days and called them back and upped my offer to $5k to expedite the process and again they rejected the offer. I will not make another, I will postpone my refi and follow the procedures of the court to have this removed.

I cannot believe they would turn down $5k on a loan they most likely paid $500.00 for if indeed the debt is legit (I know it is not legitimately mine) in their minds.

Received a collection letter from Oliphant which in turn sold it to a company called Stonleigh Recovery. What a joke! says its from citibank must have been 154 years ago. I have accts with with Citi now. Amt.848.00. Might of been 10.00 yrs ago. They are wasting there time and phone calls. How do they get a ph. number not in my name. I told them I died.............:cool:...

If it is NOT yours do not pay one dime. Enter a statement in all 3 credit bureaus . IN DISPUTE. NOT MINE.. Counter sue in civil court In Iowa up to 5k.. Record ALL ph. conversations, time, date, content.... Contact the original creditor and have them contact the Low Lifes.. :p
