I just received a text message from a friend of mine saying he got a voicemail message from a Laura Gomez. I called the number and it is to Nation Recovery Services. They are trying to collect on loans from CMG, SSM, Midland Financial and e-dollars. I have never even heard of e-dollars so I don't know where thats coming from. Anyway I went round and round with them asked for agreements with my electronic signature she said she didn't have it. I was nice but firm and explained that I never applied for loans with these people. That I only applied for one with a totally different company. She was nasty at first and gave me the speech about keeping the money etc and that these companies have protected themselves (even though I told her they were illegal in my state NY) She said that only PDL stores are and not online loans. I told her that I have paid these companies more than the $300 that was put in my account. She got nicer and said that she was half and half on weather or not my particular case was fraud ( I told her it was) but that she could settle the debts for $252 each (CMG, SSM & Midland) and 0 on e-dollars. I just want to be sure that PDLS via the internet are illegal. I am scared to death right now that I am going to be haunted for life by these people. I sent a C&D letter to this National Recovery Service. I also got an e-mail yesterday from nhcash saying I owed them $499, I sent them a C&D too. I took care of things at my bank so I'm not worried there. I'm just scared that I'm missing something and that there is a loop hole somewhere that I'm going to get sucked down!!! Any advice? Also does anyone know who e-dollars is and how I can find out if a company has a license? This is a great forum and ever since I have been dealing with this I come to it everyday!! Sorry this is so long 8-)

in new york all pdls are illegal, internet ones too.if you paid back what you borrowed you are done.one question, did this woman
have a thick accent?just checking.

EDollars Direct is the same as SJM Marketing. Their phone number is (866) 722-2770. Paul is correct, you are done with them. Does the company that contacted you claim to be a collection agency for the pdl's? If so, tel them you expect your dunning letter in the mail within the next 5 days, per Federal law. If you receive a dunning letter (and I doubt you will), send off a debt validation letter. Did you also include a wage assignment revocation in that C&D letter?

Here is a sample, it's just notifying you that they are attempting to collect a debt, after their first contact with you, they [collection agencies] are required by law to send you a notice that they are attempting to collect a debt.

404 Liberty Street
Trenton NJ, 08650

Creditor: McKorner Furniture
$2700
Account Number. 123456789

Dear Mr. Nopay

As of today you have not voluntarily responded to our efforts to collect the overdue payments on the above account. Therefore we must advise you that we have prepared a lawsuit which will be filed against you in exactly 7 days from the date of this letter if we have not heard from you within that time frame.

We must also advise you that we fully intend to pursue garnishment of wages, liens against property, and the attachment of all financial assets and that the cost of these actions, the lawsuit and any statutory interest charges will be added to the amount owed above.

Sincerely,
Bill A. Collector

I also live in New York and I think that was an edge in getting these slugs out of my life. If you have repaid what they put into your account, you are done. Plain and simple. For what it's worth, I just kept on sending my C and D letter, day and night, until they finally realized that I was right, and they were wrong. I had 5 when I came here and within 3 months they were all resolved, and to my benefit. Keep at em'.

She didn't have an accent. Ok I'll request the letter from them. Yes my C&D letter revokes everything I could possibly think of including wage assignments to them, their successors and all affiliates of any nature of kind! LOL I have such a headache. I was feeling ok about these until today, I want to cry. Can anyone tell me how to find out if any of these companies have licenses in other States? CMG Group, SSM Group, Midland Financial, ameriloan, NLS and nhcash. Thanks everyone.

I'm not sure about any but ameriloan but it doesn't matter whether they do or not. They are prohibited in New York. They are illegal as all hell. You only owe what they gave you. You have secured your bank account, you have revoked any authorizations you gave them, you are golden. Wipe away the tears, take a Tylenol, grab a cup of tea and soon these PDLs will be a distant memory. All will be okay.

Ok don't shoot me but I'm getting confused now. I just called the NYS banking department because there number was listed on another forum regarding pdls in NYS. It said to call if you have been involved in PDLS etc... The women said that even though they are illegal in NYS if they were done via the internet, they could be legal????? Does this mean I have to find out if they have licenses in another state? I just want to make sure that EVERY PDL I have is illegal before I start shooting off at the mouth at them.

I wouldn't worry about it. When I had given my information over to the AG's office they did eventually send me a request for specific information on each PDL. I honestly don't think they would request additional info if the laws they instituted were not rock solid. Also, I know that Mario Cuomo actually shut down a few PDLs that were connected to loans be given to military employees in the North Country of New York. That is why the PDLs ask if you are currently connected to the military. If there aren't any PDLs in New York and Mario shut down PDLs out of state, then I would say they are illegal via the net. If I am wrong, I am sure that someone will correct me, but truthfully, I would go by the law. Prohibited means illegal in my book. I used it in resolving my PDLs and I haven't looked back. Hope this helps calm the rough waters some.

I've also spoken with many people at the NY Dept of Banking and AG's office.

It's one of those places where you get a different answer from each person you talk to.

While I still consider NY a grayish area (since I can't get any concrete info) many many people from NY have fought these loans as illegal and won.

Thanks goudah. I say, use the State Laws and go from there. I know I did and I am totally PDL free as a result. As far as I am concerned, they are prohibited/illegal in New York. My advise to those who are struggling with the PDL world in New York, try not to stress over the "what ifs". Take the ball and run with it, as fast as you can. Close those accounts, draft those C and D letters, attach the State laws and repay only what was deposited into your account and, don't rock the boat! Just get them behind you.

good luck! they are probhibited where i live, too and Geneva Roth keeps telling me over and over that they're not. I think it's a scare tactic. Just go by the law.. these companies are awful and they know it.. Posting the NJ law has helped for me for every company except for one..
