civil citation letter from Target National Bank

I need help and assistance if someone let me know please.
I received a Civil Citation letter from a local Justice Court. In the letter it does not state for me to appear in court but it states to have a written answer with the clerk that issued this letter.
I'd like to know some advice and if need, I'll provide you with more information.


it may be just me, but this sounds fishy...."justice court"? The only references to justice court that I found in a quick search are for Arizona, Nevada, Utah and Mississippi. It also seems kinda strange to me that you were directed to give an answer to the person who issued the letter--maybe I am just too used to CA's trying to pull crap on people.

Please provide some more info--what state you live in and the wording of the letter would be helpful, like JJ asked. Also, contact the court clerk's office to check on the validity of this--if its real they can tell you.

In Texas, creditors cannot sue in small claims so have to sue in Justice of the Peace courts so it doesn't really sound that odd to me. Sounds like the OP received this straight from the court. Did anything else come with th eletter? Was it sent certified? Normally, it would be up to the plaintiff to take care of service so I would actually make a trip to the courthouse and get a copy of the complaint.

I received the exact same thing from Target. My "type of case" is described as "CIVIL Justice Claim". BTW, I am in the state of Texas. I've been given 10 days to file a "written answer" and have been "commanded to appear before a Justice of the Peace". I'm freaked out. Have No money for an attorney. Does anybody have any advice regarding the type of reply I need to file? Is it a specific "form" or just something I "write"? HELP!!!

TNB tried to sue me recently ($10,000 in the hole!). We actually did have our day in court. I represented myself. Case was promptly thrown out of court b/c TNB could not actually produce any document of my agreement to their contract. No signatures, could not produce a purchase history, nothing. Too bad Target. My report gets wiped clean at your expense.

The Burden of Proof is a bitch, isn't it? The attorney was gambling on the 99% chance of getting a Default Judgment and, in your case, lost.

Here in Pima County AZ there is a single attorney who filed 175 lawsuits for just one creditor in an 8 month period and got 173 default judgments. That's why it's so important to fight the lawsuit, not run away from it.

Anyone have their physical address? I really need the address and info for their Agent for Service of Process. They have a SD and an MN address but cannot find them registered with the Secretaries of State.....

Target Bank sued me by using CIR lawyers, served the summon, i do not have the court date yet. How do I find out my court date and how do I defend myself? I tried to negotiate to CIR Lawyers office, they seem dont care about my problem. I can not afford lawyers, please help me to find a way to defend / represent myself in the court.

today is 03/03/11 I was served just this morning -Justice civil citation for Star of Texas Credit Union, was filed in justice court, precinct 1, on march 1, 2011, plaintiff/agent juan guerra 114 e hutland dr. austin texas 78752. anyone care to direct regarding this listed agent?

Make sure you file your response and show up to court! You can demand for them to produce proof such as documentation that you owe what they say you owe and such. Whatever you do, don't ignore it or you will get a default judgment.

You should really start your own topic so it will be easily seen and in it put all the pertinent info such as who the debt was with originally, who has it now, how is it reporting on your credit reports, what state you are in, when was the last time you made a payment on the account and what kind of account it is.

Can a debt collector attorney list the original creditor as the Plaintiff if the debt collector actually bought the debt from the original creditor? Isn't that misrepresentation? Don't different rules apply if the plaintiff is the original creditor compared to if the plaintiff is a debt collector?
