PDL assistance in FL
Date: Wed, 08/06/2008 - 07:07
I happened upon this website using a google search and have been reading posts for hours.
Great info here. Kudos to all!!
Here's my situation:
I currently have 4 oustanding PDLs as listed below:
Centurion Fund 400/0 (a forum search leads me to believe this company might actually be Loan Point/Geneva Roth...but unsure)
ameriloan 300/0
A2BCash 200/74
BIG 200/80
Based on previous forum posts, it seems that ameriloan, a2bcash, and BIG are all illegally operating. I'm a FL resident.
Currently, my bank account (BofA) is being debited about every 3 days. Due to NSF fees, my account is now in the red about $500.
I'm clear on what I should do next, I just want to make sure these PDLs are indeed violating FL laws as it concerns payday lending before I start taking action.
Your help is appreciated and "Thank You" in advance.

Hi Aurbeauty,
Internet lenders must be licensed in FL to lend in FL. If none of these lenders are licensed then they are indeed violating FL Law.
Here is some additional information on FL pdl laws. You may have to scroll down the page to find Florida.

Also, here is some additional information regarding FL and a sample letter you may want to use as a template when communicating with the pdls...

Hope this helps a little. If you have any other questions, just post!

The laws in Florida regarding the storefronts like Amscot and Ace Cash Express do not apply to the internet lenders. Internet lenders are covered under Chapter 560 of the Florida Consumer Finacial Act. None the less they are still required to be licensed here. There were recent amendments to chapter 560 and I am waiting for a review and interpretation from an officer of the FLDFS and the affect on IPDLs here in Florida.
The loans you have are with some of the most difficult to deal with. Especially BIG. They will harrass you with all kinds of nonsense. Refuse to talk to them or any of them for that matter. Ignore their threats of arrest and wage garnishment. Wage assignments are illegal in Florida and garnishment is not possible either in your case. If you do not take them seriously it will be a lot easier. I will post whatever I hear back from the FLDFS. I had a similar situation with BOA and I managed through hard work to get them to refund all my NFS fees. It took the best part of a year.
Roxy & Frogpatch, Thanks for the replies. Sounds good. I'm
Roxy & Frogpatch,
Thanks for the replies.
Sounds good. I'm just getting addresses, emails, etc together now so I can launch the assault.
I contacted my bank today and the rep stopped payment on one of the debits and issued a refund on some of the fees...but not all. The branch manager said that I would be able to open another account without any problems.
As far as hassles, I'm not worried. They can't reach me by phone
Thanks again for the help.
Sounds like you have it all under control. Let us know how it go

Thanks Frog, I was hoping you would pop in on this one. Aurbeau
Thanks Frog, I was hoping you would pop in on this one. Aurbeauty, we are here if you need anything...you can search the addresses in the box at the right in the green bar, if you do not have them.
Citibank Fought Back
I just called my bank today to see why these people are debiting my account every two weeks. I don't have an account with these people and they didn't even have my ssn...I called my bank and they put a stop payment on this account. The person who answered the phone was really nonchalant and my account was actually called. Lets see what they do next. I suggest everyone call your bank and tell them what is going on these people need to be stopped. They also said I had an account with some bank I never did business with. They are voltures!
Centurian
I had the same situation with them. They deducted $1300 from my account in about 4 weeks. I have filed fraud claims against them and stopped any ACH withdrawals this company may try to make on my account! They are very hard to deal with. Are they in India?
Thanks and good luck to you!
