In Texas some pdls are listed as CSO ( Credit service Organizations) not pdls. It would be stated on the contract. If you could look at them and see if any have CSO or Credit Service Organization listed on them..it would help us. Some of these companies I am not familiar with. Being listed as a CSO helps the company get around the pdl laws. If the company is a pdl, the pdl must be licensed in Texas to lend in Texas otherwise they are operatign illegally. I will post your laws for you to look at...

I can tell you that One Click, 500 Fast Cash, Paycheck Today will not be licensed or legal... I am thinking there are a couple more that will not be licensed as pdl. CHeck n Go, is that a store front, or did you do that on line...they are both and did you take out an installment loan or a pdl loan with them?
Also, is your store front, ACE Cash Express or Advance Cash Express (ACE)? This will make a difference in how you deal with them.

Looking over a lot of these threads some of the ipdl's I got are coming from illegal places. I'm trying to get the full list of how many of these are in fact illegally ran and then how many if any are in breach of the Texas laws. With the auto payment coming right out of my account i believe some of these 300-400$ ipdl's have already been payed off. If I'm reading correctly then the illegal ones I only owe the principal like from "One Click Cash" I owe the initial 300$ and not the 390$ that they say I still owe. (Have paid 200$ so far though the auto deduction pay.) If anyone could help me with either a list or a way to look through and so I can start finding out which ones are legal and illegal it would be greatly appreciated.

Check your contracts - It's possible some of the internet ones are CSO's under another name. But it will say in the contract very clearly that they are a CSO, or Credit Service Organization. But most of these companies I know are not legally operating. Cashwink is the only one I'm not sure of.

I told him that that the majority of these pdl places were automatically taking there premium out of my paycheck on the payday that it is deposited on. He looked at me said:
"If there an illegal company not licensed to lend in the state of Texas, or for that matter the country, Isn't taking the auto-deductible from your pay check against the law or at least a breach of the FDPCA in which the bank would have to refund the amounts from the illegal store. Granted the bank doesn't know that the amounts are being paid to a lender who isn't licensed in the state / country but if you brought that to there attention wouldn't they be required to stop payment, lock the account from further withdrawals, and refund all seized amounts from the illegal companies? No doubt in my mind we would have to pay them back, but because of the circumstances wouldn't we have the option to pay back the illegal lenders at our discretion? Even at worst the Illegal lenders can't put a lean on your credit because that would be admitting they lent the money to someone when they aren't licensed to on top of making it a public record that they broke Federal and State laws by doing that."
Really looking for an answer to that question. Because if hes right or at least somewhat in the ballpark of being convincing I could get about 1300$ back and pay the legal ones or at least make payment plans and then start working on the ones that are illegal. Any info or insight on this subject would be a great help.

Flames, you REALLY need to work something out with your legal ones so that you can close your bank account before your next payday and stop the illegal ones from taking all of your money.
Did you give a post dated check to the store front ones? I've seen some people on these boards advise against closing your bank account before working things out with store front lenders because it's possible that you could get in greater trouble for writing a bad check. However, I've also seen others say that PDLs can't prosecute you for that. So maybe it depends on what state you are in.
But somehow you need to get that bank account closed, even if it means going back to the store fronts and explaining that you've had to close your bank account due to unauthorized activity. Maybe they will require you to replace the check with one from your new account (if you gave them a check to start with), or maybe they will be willing to make other arrangements with you.
Also, in some states, if the store fronts are members of the CFSA, they are required to offer you an EPP (extended payment plan) as long as you go in and request it at least one day before your due date. That would allow you to pay them back in four equal payments, with no extra interest added on. I don't know whether that law applies in your state.

You miss the payment they file the eviction. My only real option now is to borrow from friends while i go to the bank and dispute the 1300$ taken from my account.

The woman who called claimed to be from a law firm just stating she was going to send it to the attorney general. The broke at least 3 FDCPA laws so yes i will be filing a complaint. These people should not be getting away with this. Thank you so much for your help devil.
