If htey are a debt purchaser, then they would fall under the Fair Debt Collection Practices Act (fdcpa). You should be come very familiar with the FDCPA. It can really help you fight against unfair and abusive debt collectors.
If they are contacting you about a debt, then be sure to keep detailed records of every contact, especially if they have a track record of unfair or abusive practices. This includes phone calls and letters. If you have the ability to record your phone calls, then you should -- just be sure to let them know you are recording the call and get their permission, if needed (Google "can we tape" for a good article on recording phone conversations).

This company has my name erroneously in their system- they have been calling me for weeks and won't stop. I have contacted them numerous times to inform them that the person they call for is not who they are calling. They then state that my number is not in their system and that they will have IT fix the issue, but they never do. It is my cell phone that they keep calling and I find it harrassing.

The Axiant people are 1099 contractors. Ignore them. Tell one of the attorneys to stop the crap. I talked to Chris Diwan in their Atlanta office.
I owed about $18000 on 2 Chase cards. Diwan took $650. Check him out, he has Atlanta Bar and Better Business Bureau complaints. He doesn't want any more.

Like some of the other people here, I've been in touch with Chris Diwan when Mann Bracken got out of hand.
Now he wanted to know why he was getting all the calls. I told him his name was here as the "complaint attorney" for Mann Bracken. He said there are other attorneys there as well. The names he gave are in the subject of this note.
So if Chris Diwan is not there, at Mann Bracken ask for one of these other attorneys. By the way he said Mann retired and of Bracken it is only the original Bracken's son, Chris Bracken Jr. who has anything to do with this outfit.

On Friday I talked to Matthew Linkie who is in their Rockville MD office.
He said he was a little upset that the attorney names were on the internet.
But he was really upset at the possibility of a bar complaint. He wanted me to go back to the collectors and I told him no go. Collectors threatened a lawsuit, let's talk to the lawyers.
I owed near $18,000 on a couple of cards. He's willing to do $2,000 in two payments. That is not too bad. I need a week to get the first one together and that's fine with him.
He faxed a letter to the local Kinko's. So I have it if they try to back out.
So I think the advice you're getting on these sites, such as mannbrackenwatch.blogspot.com is the right stuff. Just deal with the lawyers.

If not paid, they send it NEXT DOOR(same office) to their IN-house lawyers(2or3) who RUBBER STAMP THE HELL OUT OF ARBITRATION CLAIMS to file with the National Arb-i-traitors Forum. Mann Brocken has a court hearing with Georgia consumer affairs TO PROVE THEY ARE DEBT COLLECTION LAWYERS AND FALL UNDER THE FDCA AND NOT HIDE BEHIND THE GEORGIA STATE BAR TO PROTECT LAWYERS!!!!!

DO NOT DEAL WITH THE COLLECTORS. They use intimidation to get you to pay. Deal with the lawyers. Loftus, Linkie, Diwan, are the new owners along with Bracken Jr. They're in trouble and they know it.

holiday harrassment
Even on this 4th of July, I am receiving phone calls for someone I do not know and have been for months. The calls, I found out today, are from mann bracken.
The first call came at 8am, no one here by that name (we'll take you off the calling list); second around 9 (blah, blah, blah) it seems the more you say they've made a mistake, the more they think you're hiding something or someone. Ironically, I have never been involved with debt collection of any sort and have an excellent credit rating. The last caller was informed I will be talking with my law firm. After reading these posts, they will have some names to contact. Thank you.
