OHIO PDL TROUBLES
How much have you actually paid back these Internet lenders? ACH
How much have you actually paid back these Internet lenders? ACHloan is illegal and unlicensed, they are located in Ireland, if you have paid them the principal amount, you are done with them. BIG is also unlicensed and illegal. You need to send these ipdl's a wage revocation letter and get your account closed asap, as long as you have worked out arrangements with your store front lenders and you follow through with them, it should be safe to close your account and reopen a new one at another bank. I am going to be posting your laws shortly. You need to focus on the store front lenders and get them paid off, then you can work on your Internet lenders.

I hope the information below will help you. :)
You are only obligated to pay back the principal amount you borrowed from an unlicensed/illegal Internet Payday Lender.
What should you do?
Close your account asap, if you are unable to close your account, go into your bank and ask to speak with the Branch Manager, tell him/her you need a hard debit block placed on your account immediately! Explain that you are revoking ACH authorizations from unlicensed/illegal companies, and have learned these companies are notorious for ignoring revocation, therefore it is important to BLOCK any withdrawal attempts on your account to protect your interest. This is your privilege, do not accept no for an answer. The following link will provide you important information regarding closing accounts. CLICK HERE
What next?
AFTER your account is secure send each pdl (the unlicensed and illegal) an email similar to THIS (please scroll down to locate letter template). Tailor this letter to your needs, and try to write it with the same basic concept in your own words. You will need to research and locate email addresses/physical addresses if you don't already have them, I suggest that you type the name of the pdl (example: "oneclickcash address") in the search box in the upper right hand corner of this forum. You may also search for addresses HERE at the Better Business Bureau.
File complaints: Most of the time, you can file a complaint online with the following, I encourage you to follow through with doing so, you will need to search the Internet for your state Attorney General's website, however, here are links to file complaints for the FTC, Online complaints: Federal Trade Commission., and the BETTER BUSINESS BUREAU.
Keep in mind that you may not receive a response for days, or even weeks, or, you may receive harassing and threatening phone calls. I have found the best way to deal with this is not to respond or reply, simply hang up.
Side note: If you have paid an illegal/unlicensed payday lender above and beyond the principal amount you borrowed, it might be a good idea to demand a refund and a paid in full letter/receipt. You may or may not get one or both. It still doesn't hurt to include that tidbit in your letter. :)

I searched THIS data base and could not find a license for any of your Internet pdl's, this means they are unlicensed to lend to Ohio residents. Please make sure that you follow through on complaints against these companies at the following references in the above post. :)

Do you know anything about the other internet loans? I am just worried about the internet lenders sueing me before I can get them paid. The only internet loan that I have paid on so far is the Magnum Cash advance --- they are willing to work with me as I stated.
My account has been closed that all these are drawn on ---- of course from being overdrawn so I also owe the bank $$$. Luckily I have another account.
I have every intent in paying them what is due ---- I just feel like I am going to suffacate between now and mid-October because I'm afraid I won't even have gas $. I've been looking for a 2nd job --- but can't find anything to accommodate me not getting off work from my job until 5:00 pm

Yes, I already checked them out. Just follow my instructions with the Internet lenders and you will be fine. If I were you, I would take care of the legal ones first, then you can start working on the illegal ones, just make sure you get the wage assignment revocation letter sent to them all so there will be no chance of having you wages attached, also show your employer a copy of the revocation letter in case any of these companies decide to attempt a wage assigment. :)

Thanks so much ------- I really appreciate it. I really want the storefront lenders paid --- cuz who knows what is going to happen with the new Ohio Law that is supposed to take affect Sept. 1st.
I think they should just be illegal period! Especially the way they are allowed to prosecute you.
Any how --- I am only obligated to pay the principal amount on the internet lenders correct? I had the Quickest Cash Advance (MTE Financial) say she can not set up arrangements through mail / email --- they do not accept money orders and I know that the amount she stated was 4x the original loan amount that was owed.
I just defaulted on all the internet lenders July 31st. I have only heard from 1 of them so far.

Big and ACH are both off shore illegal lenders. If you ask them to validate the debt they will nit be able to. Forget about them doing anything to you, they can not. They should be the last ones you worry about.

I have had pdl yes report me to the credit bureuas, they sent my acct off three times, and each of the places sent it to the credit bureuas, i am in the process of getting them removed, i disputed all of them, and one has come off so far, just waiting on the rest!
From what I have heard they have to supply a contract or something. I not a hundred percent sure on how it works, but so far 1 has come off and the other 2 are still in investigation.
I will update you though as to what happens. Have you sent your letters off?

I'm not sure where you may have heard it was difficult to get pdl's off of your report but it's incorrect. At least in my case. Just make sure you keep all your paper work to submit to the CRA's. Also, I would venture to say that illegal pdl's would be easily disputed with a CRA, with you being in Ohio, none of your Internet lenders seem to be licensed. I couldn't find a license for any of them. :)

I plan to get all the letters out today ---- hopefully I can get addresses for all of them. Because not all of them are willing to give you a physical address to send certified receipt. Does email work as well?
I have just been so nervous about all this ----- I don't sleep well :-(
As far as magnum willing to work with me ----- the emails I have received are from Cash Call.
Do you guys know anything about quickest-cash-advance (I believe they are a part of MTE Financial)? They said they were going to send me to an outside collection agency.
You said BIG and ACH Loan are international. I know that the World Wide Cash is based in the United Kingdom.
I just hope I can get through all of this ---- especially with the storefront's --- so I can get my credit cards back on track. I'm half tempted to call them and explain the situation to them as far as why I am behind.

You need to send them out as many ways as possible, when I sent mine I sent them via fax, email, and certified mail (that is really the best way, so you have proof)
And yes BIG and ACH are intn, and they are scum!!! Just use your search engine and read up on BIG, they are the WORST! ACH is right behind them.
I know this can be a stressful time, but try and relax a little, you are going to have to after you send those letters out because you will start to get phone calls trying to intimidate you, so you have to be able to stand your ground with those scumbags (the illegal ones) cause they will try and tell you everything under the sun!!
Good luck, and keep us posted

I'm just not so sure I can keep all this up for 2 months with the EPPs. I need gas money --- food money and a little for the unexpected things for the kids since school is starting.
I'm really worried about the new Ohio PDL Law too ----- nobody can say exactly how it is going to affect everyone. I sure hope they don't get enough legitimate signatures for it to even be put on the ballot in November. If it does ---- I pray to God that it is voted down!

Have you revoked voluntary wage assignments with all of the illegal PDLs? (It sounds like you have payment arrangements with the legal ones.) You also need to give a copy of the revocation to your employer, in case they try to put one through anyway.

They said I still owe $387.00.

My Quickest Cash advance PDL, I believe is starting to haunt me. Of course the first girl I had left messages for because they are only in the office until 5pm (I don't get out of work til after 5), got snotty and said they will not set up an arrangement via email. Which is a line of crap to me. Do they just not want anything in writing?

I'm not a PDL expert, but if the PDL is not legal in your state, then I don't think they can force you to pay back anything. I would just tell them that you have discovered that they are not legally able to lend to residents of your state, but that you are willing to pay back the full principal amount borrowed, via money order only, in exchange for a PIF.
As for getting addresses, try typing in "name address" in the search box at the upper right of the screen. For example, "Magnum Cash address." If others have found and posted the addresses, you should be able to find them that way.

To all those looking for information regarding Cash Call: Cash Call is NOT a payday loan! They are backed by a bank. Federal Law allows them to operate when backed by an FDIC insured bank in any state without a seperate license. Federal law also allows them to import the interest rates from their home state. Since they aren't a pdl, they don't follow the same laws. Cash Call will sue someone if they don't pay, and they will win because they are 100% legal. Since they are backed by an FDIC insured bank, usually First Bank of Deleware, they are allowed to import their interest rates from their home state. So the interest rate of 99.24% is totally 100% LEGAL. This company sucks! They are evil, evil, evil. If you don't pay them, they will sue you. But they won't sue you right away. They will wait a few months so that your balance ballons up, then sue you because they know that once a judgement has been entered against you they will not get their 99.24% interest any longer. |
You're going to need to stand firm with these illegal companies,
You're going to need to stand firm with these illegal companies, tell them if they won't email you an address to send payments via money order, than they won't receive their payments, this way you will have it in writing that you were making every effort to pay them. As I said before, any company that is not licensed in the state of Ohio are lending to Ohio residents illegally, what that means is you are only obligated to pay back the principal amount, I don't care what they tell you, Ohio law prevails.

I'm sorry shazzers it is Call Center Services that I got the email from. NOT CASH CALL Also -- on the website it says International Cash Advance 2008
Sorry!!!
I have made the following payments on my EPPs:
ChecknGO $228 (Orig 912.50)
Check Into Cash $228 (Orig 912.50)
Quik Cash $145 ($575)
I need to pay my Purpose $ in full on the 29th! I just can't do it. I also have to make a $238 Payment to cashland. Both of these PDLs have a $932.50 Balance.
I wish that I could find a parttime job to get these paid but I'm having no luck with that.

Shazzers:
I had stated that World Wide Cash is still open on my current checking account. I got a $200 loan and Have already paid $89 dollars. Should I put a stop pmnt on my next pmt of $89 and use those $ on my legal loans? Do you think they will try and debit my account under another name?
I know they are way illegal too --- they are from the UK --

I'm afraid they will make every attempt to retrieve you money if you place a stop payment, illegal companies will stop at nothing. I wouldn't feel safe just stopping payment, and once you do that, it will make them mad, then they will use another name and debit the entire amount, and only heaven knows what that amount may end up being. I really wish you would either close out that account or place a hard debit block on it.
