I have talked to this company over the phone and delayed thier collection process by telling them I would pay then on 09/03, but i do NOT want to give them my new checking information. I have filed complaints with the BBB, AG and FTC, but I have a feeling this doesnt stop them...i want to avoid the phone calls at work, but is there anyway to deal with these nasty people? it was a $200 loan and I have already paid $725. I am scared about the actions they will take. my bank account is closed but it seems from what I read these people stop at nothing to make your life miserable. any advice would be great!

Don't accept there telephone calls. There is no law that states you have to talk to them...Block their number - they can't sue you because they are illegal and besides they owe you money. Don't fall for their BS because that is all it is. You will never get the moeny back that you overpaid. So as long as your bank account is closed, you should be okay.

No they shouldn't be able to get to your new account and if they do dispute it with the bank - they will refund you your money. You can actually go back 60 days and dispute the charges that they took from you already - tell them you didn't authorize them because morally you only owe what you borrowed. If you are unable to block their calls - just ignore them...Unless, they are willing to refund you your overpayment which they won't - their is no negotiating on your part - so basically - I wouldn't worry about. That is exactly what I did - they know they are illegal and will try every which way to get more money but basically the contract is "null and void" they can't sue you nor can they threaten to file criminal charges because again they are illegal. Good luck!

You need to shoot this company an email or fax it and revoke ACH authorization and wage assignments asap! Print out the email and take it to your bank so they will know ACH transactions are legally revoked. Do you have your new account at the same bank? You might want to call your bank and speak to the Branch Manager to make sure your old account can not be forced back opened.

Big is relentless. They are an offshore company based in England and will try to tell you that you must abide by the laws of the U.K.
They are one of the worst to deal with, and will stop at nothing to get your money. Be sure your account is closed and can not be reopened for any reason

I have emailed them a letter and I have already talked to my bank. My account cant be forced back open. I have sent a C&D letter but that did work. This is the letter I used:

August 19th, 2008

B.I.G

(Information removed for your safety. cannr)After doing research regarding Internet payday loan laws in the State of Arizona, I have found that your Internet payday loans are actually illegal. I have also found the following laws to be true applying to payday loans in the State of Arizona in general:

Legal Status: Legal

Citation:
Ariz. Rev. Stat. ???? 6-1251 et seq.

Loan Terms:
Maximum Loan Amount: $500
Loan Term: Min: 5 days
Maximum Finance Rate and Fees: 15% of check
Finance Charge for 14-day $100 loan: $17.65
apr for 14-day $100 loan: 459%

Debt Limits:
Maximum Number of Outstanding Loans at One Time: One
Rollovers Permitted: Three (extensions)
Cooling-off Period:
Repayment Plan:

Collection Limits:
Collection Fees: $25 NSF fee + actual charges assessed by the financial institution
Criminal Action: Prohibited

Where to Complain, Get Information:
Regulator: Arizona Department of Financial Institutions
Address: Financial Enterprises Division, 2910 N. 44th Street, Suite 310 Phoenix AZ 85018
Phone: (800) 544-0708
Fax: (602) 381-1225
Regulatory Contact: Robert Charlton,, Assistant Superintendent of Banks

I hereby revoke any and all ACH authorizations with your company from debiting any of my personal accounts, per Federal law, Regulation E Section 205.10 Preauthorized transfers. I have closed my account with (bank name removed. cannr) to protect my interest in this matter, per instructions from The Arizona Department of Finance. I also revoke any and all wage assignments I may or may not have signed with your company, I no longer authorize you, your company, or your affiliates to attach any part of my wages or contact my employer for your collection purposes. I have notified my employer about this matter so any attempts to do so on your part will be rejected.

I demand that any contact be made through US Postal mail or email only. I will need everything in writing to keep accurate records of all communication as per instruction from my Attorney General's Office. I prohibit you or your affiliates to contact me via telephone at my place of employment or my home telephone number. I also prohibit you from calling my references listed on my loan.

Due to the fact that Internet payday loans must be licensed in the state of Arizona to be a legal and binding contract, your company should NOT issue loans to Arizona residents at all. I am requesting that you send me your license number which enables you to offer loans to Arizona residents.

The legal amount that could have been charged to my loan is the principal amount, even IF your Internet pay day loan were legal anywhere in the U.S. I am willing to pay the principle amount of the loan only; however, this is only if you provide me with a physical address where I can send payments.
I must also inform you that I will be filing complaints with the Better Business Bureau, the Federal Trade Commission, and the Arizona Attorney General's Office.

I expect a response from your company no later than 5 days from the above date regarding this matter. This response may only come via US Postal mail or email. No telephone contact is permitted.

But not even 30 minutes after I sent it they were calling. Then the following day they called me at work. There is no valid address to send the letter to so I was only able to fax it and email it. I have also sent this letter to my bank. I really want to avoid the calls at work. How long do they call before they give up and leave me alone?

It doesn't hurt to send them letters but just know they will have no affect other than if you use them as proof for your bank or something. BIG is a scam though and their goal is to get you to give elctronic access to your accounts so they can bleed them dry. Just hang up when they call. I wouldn't even let them say a single word because I hung up so fast unless you just feel like messing with one of them.

I am completly freaked out about them contacting my work. They only have my direct #, so when they call they will get me first, but when i start hanging up on them wont they start looking for antoher # to contact me at work. Once they get and 800# to my place of employment they will start harrassing other people I work with and that is what I DONT want. i can handle them calling me, no problem, but I cant handle them talking to people I work with.

jewels, here's what I did, and I think you can do it too. Since your number is your DIRECT number, answer it but DO NOT SAY YOUR NAME. If it's them, tell them "she no longer works here". I had to to it to prevent them from calling my workplace 1,000 times. Worked like a charm. They stopped calling my work, but they called my cell a million times. I changed my number. Just remember, they can't do SQUAT to you, honey. NOTHING. Do not be afraid of them. At all! Just try the "trick" of you not working there anymore and the calls to your work should stop. Hell, it's worth a shot! Just for awhile, don't say your name when you answer.......

Thank you for the advice, sounds like it will work, but If I dont answer, but automated machine automatically says my name....which I cant get around since its system generated. But hey the one time they get me and I say I dont work there, might be the only time they need to hear it, if not i'll have my boss tell them I dont work there! So simple, yet I didnt think of it!! Thank you so much!!!

There is a slight risk they might harrass some other employees but generally they won't. I think my wife's boss talked to them on the phone once and basically said the company will not tolerate personal calls of that nature and then she hung up. Basically it just put them on notice that her company could care less and they would get no where if they tried to put pressure on the company. I talked to them twice after she let me know about them and told them there is no way in hell my wife will ever pay them a single penny and there isn't a damn thing they can do about it. You can tell your boss and any other employees that might get involved that it is a scam. They stole your identity via a phishing scam and are now trying to use it as blackmail to get money from you. Just so there is no confusion that is exactly what they did.

Nah, I don't think they have that many. I used a repeat dialer and let it run for a day or so on these guys. The same bonehead kept answering over and over and over. If they had even 50 operators I would have gotten different guys. I can't remember all the MP3s I played but the guy was pissed. It is meant to be used as a telemarketing tool but if you use it in conjuction with Skype then you can call any 800 number for free including other country 800 numbers or equivalent by using your computer and internet connection. It will play any MP3 file you have or want to make. It is impossible to caller ID and only traceable back to the Skype network unless Skype releases your IP# which won't do them any good especially if your IP is dynamic. Basically they would have to do a lot of investigation and need a few court orders from different countries to figure out where the call originated from. It takes 3 different peices of free software but I uninstalled it because one of them interferred with some other stuff I was running.

Anyway I really doubt they will waste all their time flooding your phone system. It is not impossible but unlikely. I laid into one of them one day and my wife received maybe 15 calls that day. After that they tapered off over a few week period to almost nothing. The bottom line is that is their game. They try to harrass you fast and hard until you give in and pay. If you do pay then that just feeds their frenzy and they will continue to harrass you. In my opinion the best way to deal with them is to spend maybe 30 seconds and tell them one time you will never pay ever and they have no method to make you pay. After that hang up any time they call. You should also change any phone number you can possibly change including your direct line at work. You might also consider answering and telling them you no longer work there. They will probably verify it with HR though. I know they called into my wifes main 800# once and asked to be transfered to her.

They havent started calling yet. They did send an email saying my payment was missed. But I am sure the phone calls will start. I am not worried about how many employees they have....My office has over 1000 employees and I dont want them to harrass them. Which honeslty I dont think will do them any good....we have a teams that answers phones all day and its almost impossible to get through to me without the correct information, much less a manager. They will get houded for their client information which they dont have cause they arent one of my clients. I am going to try answering and telling I dont work here anymore..

They never harrassed any of my wife's co-workers although her manager did tell them one time that their company did not accept personal solicitations and any private matters would need to be taken care of outside of work. Basically she told them to F'off and after a couple weeks they pretty much quit calling.

That is what I am hoping will happen. I have paid them almost $800 on a $200 loan. i am not giving them anymore money. They are my last loan to deal with and I have a feeling it will be a headache. How bad was it for you and your wife? or was it pretty simple? Thank you for all your input..It really helps I hear these people can be a pain in the butt to deal with.

Well she was dealing with Cash Today Limited but I believe it is the same people. They were really nasty on the phone. My advice is don't speak with them because they will say all kinds of idle threats to make you give them money. You can send letters from this site if you want but the letters will not affect them. They might be useful if you need to deal with your bank or payroll department but that is it really. I spoke with them twice and both times I told them they would never get another penny from my wife no matter how many times they called. The second time I said that and then cussed them until they hung up on me. Talking with them only ends in a stalemate so it is a huge waste of time.

I didn't know she was having a problem until after a couple weeks of her dealing with their harassment. If she hung up on them they would call back repeatedly sometimes but usually not more than 5 times. After I told her they could do nothing but harass her on the phone she quit accepting their calls. The calls tapered off after that to almost nothing. They don't have any good contact info for her now so she hasn't had a call in months. She changed her cell# they had and she left that job for other reasons so they have no phone numbers now.

Unfortunately they swiped about $500 from her on a $200 loan. I have seen a couple people on these boards claim they paid them more money to stop all the calls but I don't trust those posts. It seems ridiculous to pay someone that has already ripped me off more money to simply quit calling me on the phone.
