Everyone in this community is so helpful, I was wondering if anyone knew the answer to my question.
I have 7 PDL’s, and I live in Texas. One is with Advance America. I know they are legal and I must pay them (like all PDL’s in Texas!). It was a $900.00 loan and I have paid 1,000.00 towards this loan. - but I have renewed this loan 5 times so I actually have paid much much more than that, but according to their records, the last renewal was a new loan. (They require you to actually bring in the entire amount of the loan after 5 payments and then take out a new loan. This was they can say well, you only paid X amount on this particular loan.)
Thanks to this site I got the courage to stop the cycle. I went in with a letter stating that I would like to negotiate an EEP. It told them that I want to pay the money I owe and if they would break this debt up into 4 equal payments I would be happy to pay it in full over my next 4 pay periods.
I was told that they could only accept this letter if it came from my lawyer. (Like I can afford to hire an attorney!) I told him that can’t be true since you can act as your own attorney in this country if you wish. Long story short – I paid a $200.00 payment today (which I planned on doing anyway) - I was supposed to surrender the entire amount and take out a new loan this time. They said that was fine and that they would check with their legal department and get back to me in a couple of days. After they took my $200.00 they then informed me that they would be depositing my check today (which is for more that I actually owe now).
Is this legal? Do I have any recourse? Am I stuck going back in and giving them the rest and taking out a new loan so I can pay my rent this month? My plan was to start with this one. Once it was paid to go to the next one and do the same this until they were all paid.

Welcome to you--and I will share what I know about the EPP. And I also dealt with Advance America before the EPP and know they can be a pain to deal with.
My understanding is that you have to request the EPP before your loan becomes due, which it sounds like you have done and once you fill out the paperwork, there is documentation there that says they will not do any collection activity on you--as long as you make your four payments.
I know that the one PDL that I did pay off using the EPP had to be reminded constantly that I was on it, and once that happened, there was no problem. There was nothing said about a lawyer--so I would pull the paperwork you signed first and check the documentation on it, and if it does say that, I would fax the storefront a copy of it. I would also go to the CFSA website and see exactly what they say about the EPP.

You said you paid them $200 towards your loan, but they are still gonna deposit your check anyways? Did they give you a receipt for the $200 payment? I'm not exactly sure what to tell you, but if you have a receipt for the payment, and the check they are gonna deposit is more than what you owe; I would possibly go into your bank, show them the receipt for the $200, and explain to them that Advance America is gonna deposit a check for $200 more than what you actually owe.

I can share what I've learned with these store fronts and I've dealt with 3 of the worst ones. They will take payments from you, however you have to make reasonable payments. Even after default, as all of mine defaulted. They will tell you that, but once it goes so far past due they will take what they can get. Again within reason. What all mine did was basically accepted an EPP after default although that's not what they called it. National Check Cashers even allowed 5 payments instead of 4. Making "reasonable payments" might be tuff it certainly was for me, however I made adjustments to everything I could think of in order to make it work. I have 1 more payment on my next payday and the store fronts will be taken care of, I still have a long way to go with everything else, but one small step for me....
PS if you have the money and they "won't take it" hold onto it, so if you go to court you will have something to present to the judge to show your efforts.

Bigdog, question for you... When you went in to the storefront to invoke the EPP, did you sign a "new agreement" with the payment terms? They should have had you sign an amendment to your loan documents with the EPP payment amounts and dates due. Did they do that for you? Do you have copies of that?

I did not sign any new document s when I went in. I do have a receipt for what I paid. I appreciate all of the help everyone has offered. I am hopeful that they will work with me. I did speak to the manager, and he phoned the regional manager. That is the one who told in that I needed a letter from my lawyer... (It sounds like a pressure tactic to me).
Anyway - I will keep you all posted.

Definately a pressure tactic! I would pull out the paperwork and go over it line by line. In order to go on the EPP, you do have to sign new documents which spell out what you agree to do and that the storefront will cease collection activities, as long as you make your payments.

At some point I want to say they should lock old posts but I wonder if that effects the search.
If it stops the search from finding them then I would not want them locked as they have great info and perfect for research.
If the search is uneffected then they should be locked after 3 months???
