I am currently being sued by my bank for not paying them

I am currently being sued by my bank for funds that i thought was in my account-to later find out that the other persons check did not clear-therefore-I owe the bank 4200.00 I currently am in chapter 13 bankruptcy and I am having my wages garnished from that source-what should my plan of action be? thanks tom

Welcome to the forums.

Legal actions can be taken by your creditors if you fail to make payments in chapter 13 bankruptcy. In such occasions, you can propose to modify the plan under 11 U.S.C. ???? 1323 & 1329. The creditor may object or threaten to object this changed plan but this change may be done at the request of the trustee.

Thomas, at this point, I will only suggest you to try hard and make payment arrangements. If your creditors won't receive the money from you, they can take this matter to the court.

Consult your attorney and get this plan modified.
