Don't give up if you're in a mess. I'm still demanding "PIF" letters and refunds from several of these payday loan companies. I won't rest until everything is cleared up. Best advice is to be persistent and be aware of your state's laws.
This site has been a blessing. The people on here are extremely knowledgeable and helpful. I would have never fought for my rights, if it weren't for everyone here.
Still cannot thank you all enough.

Wouldn't it be nice if all these places would refund overpayments? I know I'd be thrilled! But, a "PIF" letter is a good thing.

10/07/2008 Consumer rejects business' final offer (The consumer indicated he/she DID NOT accept the response from the business.)
Again, I found out the Indiana state laws after the fact. I notified United Cash Loans of this back in November of 2007, when their illegal fee amounts were brought to my attention. I will be continuing with my complaints to the Federal Trade Commission as well as the Attorney General's offices in the state of Indiana as well as the state of Oklahoma. Any lender lending to residents of the state of Indiana MUST BE LICENSED to lend in the state of Indiana and adhere to all Indiana lending laws - Internet lender or not.

10/06/2008 Received Business' Rebuttal Response We stand by our response, the customer came to our website, and being a previous customer knew exactly what our terms were, which is confirmed by written and verbal communication we recorded with this customer. The amount she asked to be deposited to her account, at her request for her own personal use, must be repaid. If not, then collections will continue on the full amount owed, regardless of the misinformation this customer believes to be true in regards to this agreement.

I had two loans with this company. The first loan was for $300, which I paid $960 after fees. The next loan was for $350, which with my previous overpayment I have more than satisfied the new loan and this company indeed owes me a refund in the amount of $225.50. Their contract is null and void as they are not licensed to lend to customers in the state of Indiana. In all actuality, the entire amount of $960 is due back to me from the previous loan. They must abide by Indiana state law to lend to residents of the state of Indiana.

At the time of the application the terms and conditions were presented and the customer had the opportunity to print them at that time. They had to answer a question whether they understood the terms before we could even receive the application to process. In addition, there was a 48-hour time frame the customer could cancel the agreement without incurring a fee. Before each debit we sent an account summary, which explained the terms once more, and all of the options for repayment. This form was emailed at least 10 days before each debit; it also included our customer service number to ask any additional questions. We also have a direct email link on our website to answer any inquiries. If the customer had wanted to avoid additional fees, they needed to pay the full amount due on the first debit due date, which was in the original contract, as well as the account summary emailed to the customer very shortly after the funds were placed in their own account, for their own use, at their request. The original loan documents can be faxed directly to the customer once we are given a fax number to send them to. All of her debits were returned by her bank, so she has paid zero toward the amount of deposit she requested in her account, for her own use, at her request.
We will stop all collections and debits on the account, and will reduce the current balance of $695.000 to $350.00 (the customer has paid ZERO on a deposit of $350.00 ***WAIVING ALL FEES)** THIS OFFER IS GOOD ONLY BY MONEYGRAM PAID ON OR BEFORE 10/17/08****
The $350.00 must be paid via Moneygram by 10/17/08

Their (United Cash Loans) response is such a waste of space, what do these companies who lend illegally really expect to happen? They think if they respond to BBB complaints with the same old rhetoric it will intimidate the consumer into paying the unlawful interest rates and fees they demand!? The BBB is about as useful as a screen door on a submarine! In my opinion, I think I would bombard the FTC with complaints until I received a valid response - which would force illegal companies who lend to either follow the law, or cease business all together. Of course that's just a pipe dream of mine. :lol:
