A company called MCM called me about a credit card. I admit the debt but I want to discuss what happened. A man called me and he was speaking broken English. I could not understand him and I also had a bad phone signal. So, I tell the man that I have to go and to call me back at a later time because I was also at work. He keeps talking to me and keeps trying to push a settlement offer on me. I keep telling him I have to go. So then he yells at me and says"DO YOU UNDERSTAND WHAT I AM SAYING, DO YOU UNDERSTAND CLEAR ENGLISH" that really made me mad. He could not speak clear English. Am, I wrong for being upset. Has anyone else here had that problem and what should I do about it?

The mcm # we have is 1-800- 265-8825 they will not let u talk 2 acct. Manager ... My girlfriend went off on the guy who last called me told him to shut the ---- up , and he became less demanding .... They have no documents obviously as i requested something be sent to me with my signature on it .... Also something showing where over $2000.00 was spent ...the guy said he did not have this info ...so i ask how r u collecting for something u have no proof of ? I am going to send them a cease & desist letter , and record all phone conversations ..... I will call them back so i can do this ....

For all of those who are dealing with MCM send them a certified VALIDATION of DEBT letter (type in DV letter or Debt Validation letter on the internet and many pop up, cut and paste and type in your name) send it to them and wait. Most likely they will send you a letter stating that YOU did not provide enough information for them to validate the dispute. This is INCORRECT! THEY must provide the information to you NOT the other way around. After you send the DV letter keep a copy for yourself along with the certified mail receipt, if they don't validate the debt within 30 days the debt is invalid and any information reported to the credit bureaus MUST be DELETED. If they continue to call or write or have not removed information from the credit bureaus file a law suit! Oh and one more thing DON"T talk to them! Simply don't pick up the phone or if you do and you realize it is them hang up! The letters that they send to you and the collection agents that you speak with are meant to scare you into paying them, that's what they are in business to do. Simply put; make them validate the debt FIRST (chances are they won't or can't) if they do then and only then do you give them the time of day.

#105-your half right. Texas is the only state the collector has to validate within 30 days, the rest are unlimited time frames. But, if they have not validated with in 30 days for other states then I would file a dispute with the credit bureaus anyways to have it removed

I know,....they call our house looking for a Robert ROY, who currently lives on the street that we lived on in the late 1980's. Our last name is ROWE, so it is close. What really bugs me, is Robert ROY is listed in the white pages on that street, with a phone number! I have contacted them previously via email not to call here looking for Robert ROY, and that lasted almost a year..now they are calling again!

I have an Atat acct 10 yrs ago and was bought by a collection agency. They kept on sending me letter for collection over and over again. Based on the statue of limitations here in MA it's 6 years. How do I go about doing this. And Can I write my own cease and desist letter or do I have to get a lawyer write it?

The idiots called me at 9:30 p.m at night. I didn't know who they were. The said they were a "business." I told them if they were a business, business hours are 8 a.m. to 5 p.m. The lady told me she knew the law and I asked for her attorney bar number and she said, what is that" We argued about that and I demanded the name of the company which they finally told me was MCM. I then told them I would be reporting them to the BBB.

:confused:We have paid a Debt off in regards to a cell phone a year ago. Now MCM is harrasing us again. Telling me that we need to send them a letter that it was paid off and this and that. They wouldn't give me an address. They were rude & nasty. They said things like "you are not listening, you have to pay this NOW" . I said to them that I had conntacted the company that the original debt occured with (Verizon) and they told me that there are no outstanding debts. That this is Bogus and I shouldn't give them any money. When I mentioned this to the "Manager" that I supposibly had on the other end , he asks me why I called them ? Well Hello??? I tried to get to the root of the problem. Also the Verizon Rep. I had spoken to said to tell MCM to call them and they would settle this. So I tell them to do that and he said "thats not my Job and you get the letter for me or we will call you every day" . So I told him , go ahead call me every day , I don't give a flying rats ass.( Sorry for the bad language but I was mad) English is my second language but my english speaking skills are definetly better then theirs and I dont have such a heavy accent.
All I have now is a phone or fax number. How can I get their address? Everybody on here says to send this letter "Certified Mail" but I don't have the address. Can someone please help me.

We had been dealing with MCM for several months over the phone. It was a rather weird ordeal because we weren't sure whether we actually owed the debt. Eventually, after concluding that we did indeed owe the debt. we called them back and they made a reasonable offer to settle the account.

If you do actually owe the debt, make an effort to settle it. They knocked off about 40% when we called them back. It doesn't hurt to try working with these people if you truly owe the money.

:!: MCM keeps calling my home for someone who used to live at this address. I have asked them numerous times to stop calling here, that the person they want doesn't live here. they still call at all time of the day and night...well I finally lost it and this time I asked very nicely, got the company name, some info, and then went off on them..."understand this...you speak english, you under stand english, the f'n person does not live here, nor do I know him, get it? So...stop f'n calling here because if you do continue I will continue to swear at you each and every time and you will have a shitty day and....you're not gaining anything.
No calls so far.

I mean, Charlie Sheen style winners!!
Unknown caller, 49 times in 6 days. This was the 50th call so I answered. A male with a thick Indian accent, named Ronnie, asked for someone I don't know. I stated that and asked what company he was with and asked why they had called 49 times in 6 days. He asked how I knew that it was them and started to it may not have been them that called and they are on an automatic dialer. I cut him off telling him I know how automatic dialers work and asked for the name of his company. He told me he could not give me that information and began to repeat what he had told me about automatic dialers. Again, I cut him off and asked for the name of his company. After about the 6th time asking that question, he finally yelled that his company was called MCM. So...then began a lengthy question/non-answer session of what MCM stands for with no luck in him telling me. I asked for his supervisor and he let me know he was in a meeting. I asked for his supervisors supervisor and he informed me that they were all in meetings. So, I asked for the supervisors name 5 or 6 times and he finally told me his name was "Mark". I asked to have "Mark" call me back. He said Mark would call me. I asked what the time frame would be and he didn't know so I asked if we were talking an hour? Two hours? Two weeks? He said probably one or two hours. I asked again what MCM stands for and he told me he was disconnecting the call.
Now, based on this, I DO think they are a legit company, just a little uncouth. Some of his responses sounded like he was a person facing grading from QA otherwise, he probably would have hung up early in the call and not called me "Sir" so many times.
Hopefully, the calls stop and we'll see if I get a call back from "Mark".

the mcm stands for midland collection management .. i was a bill collector for 10 yrs and know the fair debt collections act.. which requres that all collection agencies are requried to disclose their full name. (not just mcm) or they are breaking the law and can be fined up to 1000 per incident.

I argued with their rep for 10 minutes, who as stated by many before did not speak very good english, before he put his manager on the phone. i insisted they disclose their name in full citing the fdcpa or title VIII law. finally he did disclose .. They are always suspicious and did try to make me give my full name.. you do not have to . i gave him my last name .. that was enough..

these people are what gives collection agencies a bad name.. not all companies are like this.. if they are above board.. their reps use their real names.. and give the company name with out a 15 minute fight..
check your states limitation laws most on credit card are 7 years.. after that .. they can not report to your credit report or sue you. however. if you make a payment you renew the stats of limations and they can report and sue you..

I'm always concerned when someone comes in here and tells us how well they know the "fair debt collections act", and then they proceed to get it so wrong. First, its the Fair Debt Collection Practices Act, or FDCPA. Second, the penalty is NOT "$1000 per incident", but the statutory penalty is up to $1000 TOTAL no matter how many violations they have committed with you. If they violate once, or a hundred times, its still a maximum of $1000 in statutory damages that you can sue for. you can also sue for actual damages, harassment, etc etc etc....but the statutory amount is as I explained, not "per incident".

Also, it is not a "fine". A fine is what they would pay to the government agency that enforces the law. It is a penalty, that they would owe to the consumer, but only if the consumer that they violated the law with chooses to sue them.

Either you were a lousy debt collector or you worked for a CA that didnt care about the law. Your last name is NEVER "enough". They need to know if they are speaking to the right person. They are prohibited by law from discussing the matter of your debts with anyone except for you, so they are well within their right to ask you to identify yourself. It is that simple. The only time that people do not identify themselves is when they do not know how to properly handle their affairs. If you owe nothing, you have no reason at all to be afraid to identify yourself to them. If they break the law, then step up and take action against them. If you owe something, you still need to be honest about who you are and give them your name. Now, I NEVER advocate that anyone hands out their SSN or bank info, but there's nothing wrong with telling the bill collector on the phone, "hey, I do not give out my SSN, but if you tell me the last four of what you have, I will verify if that is mine or not". They will do this in most cases, and you have given up NOTHING--if they have your SSN and they tell you the proper last 4 numbers, you lose nothing by verifying it--didnt they have it correct in the first place??

Stop playing games. you were a debt collector, you should know that it is very important that they properly identify who they are speaking with.

Quote:

Heres another serious flaw in your claims. you did not even identify yourself properly to them. The law(you remember, the "fair debt collections act"??) specifically states that they are only to identify their company to a third party when expressly asked to.....and there is no provision in the law that says they cannot say "MCM" when they do so. But wait--you arent a third party?? HOW DO THEY KNOW? YOU REFUSED TO PROPERLY IDENTIFY YOURSELF! It is YOUR fault that they had to treat you like a third party, NOT THEIRS. If you identified yourself properly as the person they were calling for, then they would have legally been able to tell you more than "MCM". There is a different standard within the law as to what they can disclose to a third party and what they can disclose to the consumer they are calling for. I am definitely not a fan of MCM, but this wasnt their fault, it was YOURS.

Quote:
check your states limitation laws most on credit card are 7 years.. after that .. they can not report to your credit report or sue you.
Dude, where in the world did you learn about these laws?

1--your limit is very wrong. There are TWO statutes of limitation that apply to debts, not one per state. There is a federal one that dictates how long they can report on your credit reports, and that one is 7.5 years from the date the debt first became delinquent. Then there is a separate SOL within each state that dictates how long they have in which to bring a lawsuit against you. They are not one in the same.

Quote:
however. if you make a payment you renew the stats of limations and they can report and sue you..
This is also very false. Making a payment on an old debt does not in any way restart the clock on the reporting statute of limitations. That is a federal law and the date of first delinquency can only change on a debt that is still open. When you have, say, a credit card debt, after some time the OC charges it off. The account is closed. You cannot still go out and charge on that card, even if you made payments at this point. The account is done. So, therefore, the date it first became delinquent will always be the same--if you could pay off the balance and bring it current, and then use the card again, it is possible to become delinquent again, thereby changing the date of delinquency. But the account would have already been closed and charged off before years go by.

There are also other factors that come into play when discussing the state SOLs. One state SOL law actually says that the debt is 100% uncollectable once the SOL expires, in all other states the SOL expiration means they cannot sue you but they can still call, send letters demanding payment, etc etc. If you open a debt in one state and then move to another, the state you currently live in is the SOL that applies to the debt. A lot of debt collectors do not know this, or do not want you to know it, and if you try to tell them they will fight you on it.

I've read enough posts about MCM to figure that their either a scam or a hrassing company.

"MCM" has been calling for the past 3 months for a T-moblie bill that was paid over 3yrs ago. Their rude and irratible. The call me at 7am, noon and 9pm say that I owe $300+ in debt, that I know I already paid, because at them time I needed a new phone and couldn't get one til the following month due to this unpaid debt. I told them that I wasn't me at the current number, even though since 2 yrs ago I had, 3 new numbers. They have recently taken to calling me at my parents house number, they said the same as me. NOW their sending me letters and the price has changed to $600+ in debt owed, I got that letter today. So I looked up "MCM debt colletion agency" and started reading forums on this company. NONE are positive, and now I have some questions.

1. How is that they got my current number when, it wasn't even known when I signed up for T-mobile?

2. How do I get them to stop calling and mailing me? (C&D letter? DV Letter?)

3. Who can I talk to anout taking action for harrassment from this company, legal action. (I want to see this company "burn to the ground" for all the bull they've put me through.)

The only thing I can see as harrassment is them calling you at 7am. Calling is based on your area code on your phone....dialer wont call unless it is in legal calling time. Do you have proof?
Have you sent them proof that you do not owe the debt? Receipt or paid in full letter??

I have debt from 3 years ago that I am unable to pay. I lost my job and am having to live off of $500 a month from the government, unfortunately. MCM keeps calling me. Its the same man and he yells and screams at me, calls me names and tells me things like DONT PLAY GAMES WITH ME!! I told him he cant call as early as he does and Ill turn him in for harassment. But I dont know how to do that considering he calls with a blocked number and, after the 100th time of him calling, I finally got the name out the company out of him. Hes from India and gave me a fake name. How can I make this stop? Im from California.

They have been callling me everyday for a week. I have no debt and as your phone call it was broken up. I answered but didnt say anything. I heard a woman say "someone answered but they dont want to talk". So I say "hello". A man that I could not understand at all kept asking if i was " lets say mr x". When I asked him what company he was with all he would say is MCM. He would not give any other information until I confirmed my name (which I did not). He became an ass to me so I screamed some very ugly language to him. This is a scam so beware.

He is NOT doing anything illegal by calling you and NOT disclosing what he is calling about because YOU will not identify yourself. BY law he is saying all he can say. You are exhibiting typical debtor behavior by being childish and rude. Be an adult, ID yourself...if it is not you they are looking for, then send them a cease and desist letter.

People, people, people. Listen, pay it. Don't delay it! You know the drill. When it comes to collectors, respect us, don't neglect us! Soaplady is showing you what's what, so it's time to listen up. Credit card companies did you a solid, and you left them holding the bag, so that's why we are now part of your life. Sorry. You did this, not us! Now, we will be cool and go by the golden rule, as long as nobody acts the fool! No, but in all seriousness, it's like this. A little poem I have hanging in my cubicle. It helps me when I have to collect. And sometimes I even have to collect on friends and family. As I tell them, it's never personal. Anyway, here's the poem.

Here we go another day.
Another payment someone just had to delay
Take me back to another time
When good items cost only a dime
Oh how I long for that good old past
When summer was fun and smelled of fresh cut grass
But those days are no more
Some people, their bills they just ignore
Dismiss their bills with a hardy laugh
All they while they take a nice hot bath
And giggle about me just trying to get them to pay
They could care less, they scream as they say
Oh well, that's the life I chose, so it is what it is
Till tomorrow, it's off to my biz

I have even had to collect on my own mother. It's true! She defaulted on a credit card and heard that the debt had been sold to my collection agency. So she thought I was going to cut her a break, you know, given that she was my dear mother and all. I specifically requested her account so that I could show her that she was nobody special. And it was quite interesting to say the least. She stopped speaking to me. Took it so personal. I told her not to expect special treatment. Did she think I was just kidding? My father also got mad at me. But, at least he did pay me a settled upon amount so that the whole issue would be taken care of. Well, after he paid me for HER debt, he told me to get out of their lives! Fine. Great. No problem. Some parents they are. Disown their son for doing his job? Even other family members won't talk to me. Well, that is just fine with me because I am ashamed of them anyway. Next time I see my mother and/or father, I will pour water all over them! If my mother didn't want a 3 AM phone call from her first born, then she should have paid her original creditor like she agreed to do years ago instead of thinking that since I was a debt collector, she was going to just skate on the whole issue!

Smart mother....she should have whacked you a few times more on your head.

Was this not a violation your company policy?? Any other company I know of, collecting from a family member is a no no.

So your break company policy and embarassed the hell out of your mother...tells me a lot how you would treat people you dont know.

You are a scumbag.

Dude, you are a real piece of human waste. Actually, that is an insult to human waste. I owe human waste an apology! Go crawl back under whatever rock you crawled out from under. Collecting on your own mother, and being proud of it? WTF? As bad as calling ANYONE at 3 AM is, it is THAT much worse to do it to your own mother. I don't know the details behind your mother defaulting on a credit card, but I can tell you that she did not deserve to be treated that way! Nobody does. You bullied her, you lowlife piece of garbage! Way to go. If I was your father, I would have kicked your ass all up and down the street for harassing her the way you did. Then, I would have sued your sorry ass for that harassment. I'm not condoning ANYONE not paying what they owe. But, you know good and damn well that there are ways to go about it. People like you just think that you can do whatever you want. You don't even care about your own family. Just when I thought I'd seen it all from collectors, you go and sink to a new low. If your mother and father and other family members never forgive you and never see or speak to you again, it will serve your punk ass right!

least known consumers you clearly can't read well, any collection agency is obligated to validate your request per FDCPA with in the first 30 days of the FIRST letter sent out to the consumer, after that 30 day validation period, is the consumers burden to prove that they do not owe alleged debt, also companies like MCM purchase portfolios from these companies, they do not "make up debt" when they purchase these portfolios they do not know what there getting, thats when you guys come into play, if you do not want people contacting you asking for money, don't rack up credit cards you cant pay, or just pay your bills on time. some of them are actually mistakes that the previous creditors made, my advise to you is to check your credit report often, and make sure everything is correct, there is a lot of fraudulent cases out there.

another post that is the garden variety humanoid.a couple of things

1)this place ignores validation, dispute letters so lie on the phone.

I personally love collection agencies. That is because I used to work for one, so I know the laws for my own state. I know what they can and can't do. They truly hate when I inform them that by law they are not suppose to threaten people, they are NOT suppose to call cell phones, etc and so on.
MCM called my home today. The guy spoke broken English, was very hard to understand what the hell he was saying, I simply took down his number and said goodbye. I only hope the company calls back again, because since they already left a message and/or talk to the person they need to, they are not suppose to call back for 7 days. It's the law.
Honestly, they have more information than they allow you to think. They know who the collection is from, they know the amount, etc and so on. You can also tell them that you will not be handling it through them, that you will only handle it with the person who put you in collections. Send a cease and desist letter and be done with it.
If you tell them they are calling your cell phone and you inform them of this, by law they are suppose to remove that number from their system which can take up to 24-48 hours, so you may receive a few more calls from them before it's completely wiped from their system.
Do not tolerate their barbarian ways. If they want respect, they need to give respect. They are only after money. They get commission and have to meet a certain a certain goal each month or they can lose their jobs. That's why they're being hot headed jerks.

These debt collection agencies "buy" uncollectable debt in some cases for pennies on dollar. These collection agencies spring up as mushrooms after rain and sell back and forth old debt. Most times the contact info on old loan app's is out dated and people have long since moved and are hiding from collection agencies. Some collection groups only have trac phone #'s and every time service lapses becomes someone else s number.

My husband got NUMEROUS calls recently from an "unknown" caller. Plus got an odd number with only 4 digits too. Started at about 8am today. Finally my husband, who is DEAF I might add, gave the phone to me.
In a very bad connection, with VERY broken English he kept demanding to speak to my husband. Would not talk with me, and when I told him that he would have to speak with me because my husband is deaf he called me a liar, but finally relented and let me hear stuff.
Explains he is with MCM and it is a debt that my husband HAS to pay of nearly 200 bucks, pretty good since he has already made arrangements with these guys in the past to pay the bill. supposedly payment arrangements were set up, but just never seemed to get the papers that were promised in the mail.
I stop him and demand to know why his phone number is hidden, since he is a business FCC states he HAS to reveal his number. He tells me they do not have to,and it is impossible since there are over 2000 phone lines being used by his company and there is NO way that they can show up on all the people who owe them money's phones. I asked him if he understood that no matter what he said it was illegal and against federal law to be hidden like that. He told me that once he gave me the phone number and I wrote it down then he was no longer hidden. I asked him if he thought I was stupid. HE SAID YES! That was the last straw I was FURIOUS! He then demands my husband on the phone, again I tell him he cannot speak he is DEAF! Still runs his mouth making demands. I take down the number, and tell him THIS PHONE CALL IS OVER, YOU WILL NOT CALL THIS NUMBER AGAIN... MY HUSBAND WILL CONTACT YOU SHORTLY VIA VIDEOPHONE! And hang up.

My husband gets on the video phone and the poor translator couldnt get a word in edgewise, spent her whole time rolling her eyes. My husband demanded the man's name and he told him he didnt need to give his name and that he needed to get his wife under control. I watched nearly the entire conversation. though I am still learning ASL and some things I had to get my husband to spell for me afterwards so I better understood.. the man went from DEMANDING money, to ranting and raving how I was out of control, was attacking him, threatening him, and how I needed to know my place. THE TRANSLATOR WAS A WOMAN! She looked angry so she probably was getting an earful of a chauvinistic pig. My husband did not look amused with the call. I showed him this page, and told him that they do this to people all the time and are the ones out of control and if they try anything legally they would LOSE MAJORLY because they are very illegal. And final straw is YES we are on the eastern seaboard of the US, BUT this call came in just shy of 9PM!!!!!

That is bad enough, but this "person" got quite uppity while I was on the phone because of OTHER people yelling behind me. Yeah they are our 2 1/2 and 1 1/2 year olds that WERE settling down for the night until this overseas phone call comes in, plus our 9 month old who was startled awake by the call.

Guys be careful with that company its not legit I just received a call from this company everything that you said about the way they speak etc.are true.. what they are trying to do is to get more information from you "steal your identity" he tried to get my last 4 digit of SSN but I told him I will not give it to you because your not the bank, your a 3 party company and you should have that digits in your record but when he gave me the last 4 digit of my SSN on their record its not the right one maybe he was like expecting that I will correct the SSN that he told me nahhh I am not stupid! :) and another thing they called my wifes cell no. not my cell no.so on that spot its already bogus. So guys be careful on giving out your informations to this bogus guys!

By the way I am not deliquent with any of my debts or credit cards like what he is telling me to settle. :)

MCM CRIMINAL GROUP

I suspect MCM group is using low-paid foreign workers from India who could speak English. I suspect the Job of MCM is to keep calling the same number over and over asking for a Fake name or Non-Existing Person. This is a NEW kind of Making Money invented by the Chinese and India, the purpose of strategy is to bother people so they have to deal with the bills that they never owe to avoid being harassed, I suspect MCM group also using the other method is to report to 3 credit bureaus the deb that victims do not owe .

MOST of people in US don't pay the deb that we do not owe but estimate 02% of rich people will pay to this kind of threat to avoid being harassed or to face a bad credit reports .

The math is to make phones call to thousands people a month and .02% of rich people who will pay, as I suspect it is MCM group will Make A Fortune by using this criminal method. Recently, Vietnamese police arrested 10 Chinese doing this kind of business in Vietnam .

If MCM group is a legitimate collection agency , they will not have more than 1,000 complaints file in BBB website about "wrong number" harassment phone calls, false credit reports, also thousands of people report about MCM group on the internet about MCM group consistent with the phone calls to a "wrong person", "wrong numbers".
