Sued from before I became disabled

Back in 2005 I had a loan out for a car. I couldn't pay for it, I voluntary repo ed it and they sold it. Haven't heard anything since. I just got served for the balance of what I owed and what they sold it as $5500. The problem is I am now an amputee, disabled, and live off social security. What do I do now?


Don't ignore the summons. If you're able, attend the court hearing or they will automatically be awarded a judgement against you. If you're unable to attend, notify the clerk of the court and go from there. Your SSA is judgement proof, but if you have other assets, they will try to attach those should they are awarded a judgement against you.

Be sure and answer the summons in the time alloted. You can put that you are disabled and that SS is the only income you have, and are requesting financial hardship. If you ask for this, be sure and bring paperwork supporting this to court.

I agree with Guest, notify the original, if that is who is suing you and see if they will work something out..Good Luck..karen
