I live in ohio. I have an online payday loan through loanpoint usa also known as geneva roth ventures. the loan as originally for $300 with a fee of $90. i have already paid them $90, however they were rolling this over every week for the fee for the first 4 weeks then after that, it as going to be the interest plus $50 every 2 weeks until the loan was paid. At the time, back in may of this year, my bank account was closed because of the trouble i was having with several different online and storefront loans that were becoming too hard 4 me 2 handle.I found out through this site that all of those companies i had online loans through were not licensed in my state, including geneva roth.so i did not feel bad about my bank account being closed before they got any more money from me. I was going to wait for them to contact me, and explain to them that they are not licensed in my state, therefore it is illegal for them to have given me a loan in the first place, and thet according to the laws of my state, the maximum fee for each $100 borrowed is $15, and rollovers are not permitted, therefore the most i owe them is $345 and i have alrady paid them $90 so i actually only owe them $255. Keep in mind this was in may that i defaulted since then, when i have had to pay any bills etc, i have used a separate bank account that i have had through another bank since december, way before any of this started. this other bank account that i have has never been given to this company! I have never given them my routing number, account number, opr even name of this other bank account i have! well this week i was out of town on vacation, in another state, and i called my bank to check my balance because my paycheck is direct deposited into this account, and i needed to know how much my check was for. I had previously put $450 in that accpount before i left out of town to go towards my car payment, that as due today. when i called for my balance it said that there was an authorized debit posted to my account on 09/08 for $400, of i course i immediatly start panicking because i needed that money, and i did not know where it went, so i called my bank and they said that it was from geneva roth, hom i have never given this information to. i was furious because wether i owe them money or not isn't illegal for them to go into my account and take my money without my permission or at least without having some sort of judgement against me to do so?I asked my bank what i could do about it and they said that i could file with them to have it investigated for fraud, but that if i did that and they find that this was not fraud, then I will have to pay them $1000 fee! I will! So i need to know what to do. I called this company and the person i got there said that my account was being handled in another dept, and she transfered me, once transferred all i got was a voicemail to leave a messg, so of course i did, and that was friday morning, and still no one has gotten back to me. Is there a chance of me getting my money back? Is was they did in fact illegal? Does anyone know how they got my information? And what do i do from here as far as, should i close my account in case they try to take more money from me, and have my account number changed or what? I need advice asap!!! Please help!
