2 questions here...

1. Is saying " don't call my work or refferences since you have a working personal number for me " good enough to get them not to call everyone else, or do I need something in writing?

2. Since I'm going to default on a storefront pdl, I know they will take me to court. Does a civil judgement give a time frame for paying them? Or do they just garnish wages? I've never been sued before, so I have no clue what's going to happen, or if I even have to be there for it. Though I'm not looking forward to a server comming to my work

If you know you are going to default on your storefront pdl. Check with them and see if they have the EPP (extended payment plan) or some other way of paying them instead of cashing your check. We had one that had to put our check through but then once they got it back I would go in and make small weekly payments (I got paid everyweek) and they just added on a return check fee and a late charge, but then all interest stopped. But I had been a customer there for YEARS. Give that a try before you even think court. If you have to talk to the manager and tell them you are in a difficult financial spot right now, but you do want to take care of this but can't all in one payment, could you please break it down for me. It doesn't hurt to ask. Plus it will save them money from having to take you to court.

I have already checked to see if they are members of CFSA, and have spoken to both the manager of the location as well as the collection department to check my options.

What they told me was, I pay it, keep rolling it over or default, they ask me to pay it in full plus fee's and if I don't they take me to court.

They offer no EPP's at all and have made it very clear that they give you no other options than paying it or going to court.

They are not members of the CFSA

I've checked everything I can with them about making arrangements.

I know I can't go to jail for it, but I can go to civil court. But I'm thinking that when they do contact me for the full payemnt, they can't refuse any money I offer correct? It would go to the balanced owed. I can make payments on it to lower the amount, but I can't pay it in full all at once.

I can HOPE my bank covers the check. I know they pay a payment for me every month and charge me a fee for it, which is then covered by my paycheck. But with the new developments they are involved with at Wall Street....it may be unlikely they cover this check. Who knows.



And it is just a payday loan, not installment.

I believe they can. But if they do make sure you keep a record of when you went in and who you talked to, to make the payment. So when it does go to court you have proof that you tried to make a payment but they refused it. I am thinking that the only payment they will take is payment in full.

But you may still want to talk with the manager of the storefront or even the district manager ( I had to do that for one of mine) Because the regular workers won't be able to set up anything, only the managers can. And what they are telling you could be what they were instructed to say, just to keep people paying. So go higher up in command and you may see some results. I will see what I can dig up on this company. What state are you in?

ok I called them and they had said that if you cannot come in to pay on friday they will send the check through. But if it comes back they will send it to collections and set up arrangements with you to pay. But then if you do not pay then the CA will take you to court. So you have time. But make sure you still contact the manager to let them know that you know the process and that they will be getting the check back and as soon as you hear from the CA you will take care of it. Sometimes they will put you in collections and you still make your smaller payments at the storefront. I didn't ask about that. I know one of ours did that. So now you can breath a little easier. The number I called was 602-995-9600 that was a storefront in AZ the corporate number (which she said was not in service right now ) is 602-522-0679.
