I thought a debt was settled...

I owed a debt to May Department Stores, now purchased by Macy's, of a little over $2000. They sued me back in 2005. I, luckily, had an attorney. He validated the debt and we made an offer to settle for $800. They countered for $1300. We countered again for $1100. Their attorney said they would get back to us.

In 2006, after months of no response from May/Macy's, my attorney informed me that the case had been dismissed. A few months later, Macys began sending me new billing statements for the full amount.

In 2007, the debt went to a new debt collecter, Titan Management LLC. I offered to settle for $1000. They accepted and I paid three equal payments to them. They told me a settlement letter would come from May/Macy's within 60 days.

Nothing was ever received and, frankly, I forgot about it as I wasn't getting hounded over it anymore.

Now, a new agency contacted me called OCS. They called me and asked what I intended to do with the debt of $1000 owed to Macy's. I told them I don't have a debt with Macy's; it was settled. They asked for documentation. I have the cancelled checks sent to Titan Managment, but no settlement letter.

Am I screwed? Do I need to send OCS a validation letter and if so which one?


Tell them if they want proof to call Titan Management LLC. That is the company you paid so let them do the leg work. Also check your credit reports to see if the account is showed as paid.

Sometimes what happens is information might get crossed. The new debt collector knows they can't collect on it and it was a mistake. The problem is when you get a greedy bottom feeder they will try to get money that is not owed to them regardless.

Also how long ago did they call you? By law they have 5 days to send you a dunning letter. After you get that letter you have 30 days to dispute it. If they don't send you a letter and keep contacting you then advise them they are violating Federal laws, the Fair Debt Collection Practices Act. Advise them they must send you a dunning letter. If they refuse to ask for their address and send them a debt validation letter. If they refuse to give you their address, screw them.

If all of the above happens, get back to us, we will tell you the next step.

my question is was this settlement with titan done by phone or as SOAPLADY stated anything done by mail.without any paper trail getting the PIF from TITAN might prove difficult.

You need to contact th e old company and see if you can get a zero balance letter. If you can't get it then I am sorry to say that it isn't going to end well for you. And since the last payment date was in 2007 that make the debt within the SoL, not that I ever advocate useing the SoL expiration date to not pay a debt rightfully owed.

Titan is no longer in business. I paid a settled amount and I have no letter of settlement or of agreement. I have OCS calling me and I feel fine about this. OCS has my origional account number from Macy's but it's not the same, it's not even long enough to be an account number according to macy's. Second, neither OCS or Macy's has any idea about the history of my account. They both say that there is little to no info about it. OCS says that they got the account from Macy's but Macy's has no info, which is kind of weird, since they have to have a record of either selling or giving the account to OCS. I will call OCS on Monday and explain my situation, but unless they can prove that I owe this, they have nothing. An unmatching account number with little to no info is nothing to go on. Bottom line is I paid the account, and you all should check into the small things like the account numbers and the like. Have a great day.

I kept getting calls from a collection agency claiming they were going to sue me as soon as next week..I would hang up on them and they would call back. They denied me documentation of my debt and went from Cash Central, to CashNet, etc.. I took a loan out from CashNet USA but the debt was settle years ago.. so I asked CashNet USA and got this response when asking if a company called OCS worked for them:[COLOR=#3F3F3F][FONT=Verdana][COLOR=#3F3F3F]Lisa: [/COLOR]Please contact our Fake Collector Department to make a formal complaint. Amazing, about the same time as Kimberleebeth, a friend of mine got a call from some Indian guy saying that he was calling from Out of Court Settlement Legal Department aka OCS. He called at my old job (I hadnt work there in years) and she told him that I no longer work there. He tried pressuring her for my number and she told him no, she's not giving out my number to anyone. So he left his number and instructed her to make sure i call him ASAP.

Long story short...I finally called back today and he was asking me for my SSN & date of birth. I refused to give it to him. I wanted to know from where he was calling. He told me that he couldnt give me that information until I gave him mine. He went onto threaten me that I was being sued by some company that I loaned money from online and that the marshalls were coming to my home to investigate me and he was having me recorded on the phone (after being on the phone for about 10 minutes). I eventually told him that I know about these scams and I was going to file a suit against him & his false company. I have no knowledge of any such loan or anything. I would not take out a loan for a mere $300, that's grocery money. Once I told him I'd report him to the Better Business Bureau & Consumers, he told me then fine & he hung up.

Ridiculous.
