I have been fighting Midland for the past 4 years in regards to their tactics and listings on the credit report. Thought I had one (they had all been removed about two months ago) then they started up again last month. For some reason, the original creditors are still listed as well even though their dates are well past 7 years. When I phoned the original creditors they said they would stay on there as long as Midland kept them on there. Confusing, but okay. Well, Midland has picked up calling again, listing on my credit report fictious amounts with a one month term. At one point in time I had over 15 listings for two original creditors all through Midland and their one month terms. One of them even had a date of 01/01/10 on it....hmm do they have a time travel machine?? Well, needless to say I need them to stop and get the heck off my report. I have my character review coming up in the spring for entrance to the bar and cannot have this on there....please save the lawyer stuff, I am working in public service where it is really needed. I have to address this issue either by having them be deleated by then or by paying them off and I refuse to pay on something I shouldn't. For instance, I never had higher than a $500 credit limit but they are saying, without fees etc, that my highest balance was $2655. Well, I even have proof from Capital One and Providian (the original creditors) that my highest balance was under the limit. What can I do to get them off for good and to stop calling me. They have called me at work, at school, on my parent's cell phone, and even left a message "regarding legal actions" on my answering machine. Well, I invite them to try to sue me...but this still looks bad.

If it has been 7.5 years from the date of last payment then by law they have to be removed from your report. If you have a copy of an old report that shows the date of last payment send a copy to the CRA and ask that they be deleted because of age. A CA cannot place the original creditors tradeline on your reports.

Contact a lawyer and discuss having a suit filed for violation of the FCRA.
